Terms of Service
These Terms of Service, together with any documents, policies, rules, notices, waivers, purchase terms, event terms, ticket terms, membership terms, codes of conduct, posted rules, checkout disclosures, registration terms, venue rules, and additional terms expressly incorporated by reference, form a legally binding agreement between you and 8PG.
For purposes of these Terms of Service, “8PG,” “Company,” “we,” “us,” and “our” mean 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, event staff, security personnel, service providers, successors, assigns, affiliates, and authorized designees, as applicable. “You” and “your” mean any website visitor, applicant, member, prospective member, ticket purchaser, guest, attendee, invitee, vendor, sponsor, exhibitor, performer, contractor, creator, influencer, media participant, purchaser, recipient, user, or other person who accesses or uses the website, applies for membership, purchases or receives access, registers for an event, attends an event, interacts with 8PG, or uses any 8PG service.
These Terms of Service govern your access to and use of 8pgevents.com, any related digital properties, event pages, ticketing pages, checkout pages, forms, membership portals, content, communications, event registrations, event access, event participation, purchases, memberships, services, and any other interaction with 8PG.
Your privacy is governed by the 8PG Privacy Policy, titled “8PGEVENTS.COM - 8PG - PRIVACY POLICY,” Last Updated April 23, 2026, which is incorporated into these Terms of Service by reference. The Privacy Policy explains how 8PG collects, uses, discloses, retains, and protects Personal Information, including event-related, membership-related, payment-related, SMS, email, analytics, media, security, and cannabis-adjacent information.
By accessing the website, creating an account, applying for membership, submitting information, checking any box indicating agreement, purchasing access, purchasing merchandise, purchasing a ticket, registering for an event, RSVPing, accepting a credential, using an access pass, attending an event, entering an event venue, participating in an 8PG experience, communicating with 8PG, or accepting any 8PG benefit, you agree to be bound by these Terms of Service.
If you do not agree to these Terms of Service, do not access the website, submit information, apply for membership, purchase access, register for an event, attend an event, enter any event venue, or use any 8PG service.
1. Relationship to Membership Agreement, Privacy Policy, Waivers, and Other Terms
8PG may maintain separate agreements, policies, waivers, or terms that apply to specific memberships, events, purchases, tickets, access passes, VIP upgrades, judge kits, vendor participation, sponsor participation, exhibitor participation, merchandise, private experiences, digital services, or other offerings.
If you are a member or apply for membership, the 8PG Membership Agreement also applies. If there is a conflict between these Terms of Service and the Membership Agreement regarding membership status, membership access, membership benefits, membership conduct, suspension, termination, revocation, or member-specific obligations, the Membership Agreement controls to the extent of the conflict.
If there is a conflict between these Terms of Service and event-specific terms, purchase-specific terms, waiver language, posted event rules, checkout disclosures, or signed agreements, the more specific terms control to the extent of the conflict.
8PG may require separate affirmative assent to the Terms of Service, Privacy Policy, Membership Agreement, Event Terms, Waiver and Release, Assumption of Risk, No-Refund Policy, Media Release, and any other applicable terms before allowing checkout, RSVP, membership activation, ticket purchase, event entry, VIP access, judge participation, vendor participation, sponsor participation, or continued attendance.
All terms, policies, waivers, and agreements are cumulative and intended to provide 8PG the maximum protection permitted by applicable law.
2. Changes to These Terms
8PG may modify, update, revise, supplement, replace, or amend these Terms of Service at any time.
Changes are effective when posted on the website or otherwise made available, unless a later effective date is stated. We may notify users of material changes by posting the updated Terms of Service, updating the “Last Updated” date, sending notice by email or SMS, providing notice at checkout, providing notice during registration, or using any other legally sufficient method.
Your continued access to the website, account, membership, event registration, ticketing, event attendance, purchases, communications, or services after updated Terms of Service are posted or made available constitutes acceptance of the updated Terms of Service.
To the extent these Terms of Service differ from any prior version, this version supersedes and governs your use of 8PG services from the effective date forward.
3. Eligibility and Age Requirements
8PG services, memberships, events, access-controlled experiences, and related offerings are intended only for individuals who are at least 21 years of age, unless a specific non-age-restricted offering expressly states otherwise in writing.
By using the website, applying for membership, purchasing access, registering for an event, attending an event, or using any 8PG service, you represent and warrant that you are at least 21 years of age and legally permitted to enter into these Terms of Service.
8PG may require proof of age, identity, eligibility, membership status, purchase confirmation, ticket ownership, RSVP confirmation, or other access verification before allowing account access, membership approval, ticket purchase, event registration, event entry, benefit redemption, or participation.
8PG may deny access, cancel orders, void tickets, revoke credentials, suspend membership, remove attendees, or ban users if age, identity, eligibility, payment, membership, or access requirements cannot be verified to 8PG’s satisfaction.
Attempting to access age-restricted services, events, venues, content, benefits, purchases, samples, vendor areas, lounges, or experiences while underage is strictly prohibited and may result in denial of access, removal, membership suspension, permanent ban, forfeiture of payments, and referral to law enforcement where appropriate.
4. Membership
Membership may be required to access certain 8PG events, opportunities, communications, experiences, benefits, tickets, private venues, VIP areas, judge programs, sponsor activations, vendor interactions, or other offerings.
Membership is a limited, revocable, personal, non-transferable privilege. Membership is not a property right, ownership interest, equity interest, license to intellectual property, guaranteed entitlement, or vested right.
8PG currently offers membership registration at no cost unless otherwise disclosed in writing. If 8PG later offers paid memberships, renewals, subscriptions, deposits, upgrades, paid access programs, or recurring services, the applicable pricing, billing, renewal, cancellation, and payment terms will be disclosed at the point of purchase or enrollment.
Membership benefits, access, invitations, communications, event availability, VIP opportunities, perks, giveaways, sponsor activations, and related offerings are subject to availability and may be changed, limited, substituted, suspended, revoked, discontinued, or denied at any time to the fullest extent permitted by law.
8PG may approve, deny, suspend, revoke, terminate, or restrict membership in its sole discretion, including for safety, security, misconduct, fraud, chargebacks, underage access attempts, violation of these Terms of Service, violation of the Membership Agreement, violation of event rules, harm to 8PG’s reputation, or any other reason not prohibited by law.
You may cancel your membership through available account settings or by contacting 8PG, subject to the separate Membership Agreement and any applicable event, ticket, purchase, or access terms. Cancellation of membership does not automatically entitle you to a refund, cancellation of prior purchases, release from outstanding obligations, deletion of records required for legal or operational purposes, or reversal of event-related transactions.
5. Account Registration and Information Accuracy
To access certain services, you may be required to create an account, submit a form, apply for membership, register for an event, purchase a ticket, provide contact information, or provide other information requested by 8PG.
You agree that all information you provide to 8PG is accurate, complete, current, and not misleading. You agree to promptly update your information if it changes.
You are responsible for maintaining the confidentiality of your account credentials, access credentials, tickets, QR codes, passes, wristbands, badges, links, purchase confirmations, and membership credentials.
You are responsible for all activity occurring under your account, credentials, payment method, phone number, email address, membership profile, or access pass, whether or not authorized by you, except to the extent prohibited by law.
You may not create an account or obtain access using false information, another person’s identity, a fake name, a fake age, a fake phone number, a fake email address, a stolen payment method, a fraudulent credential, or information designed to evade a ban, suspension, denial, limit, or enforcement action.
6. Website Access and Permitted Use
8PG grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the website and services solely for lawful personal, membership, registration, purchase, informational, and event-related purposes in accordance with these Terms of Service.
You may not use the website or services for any purpose that is unlawful, fraudulent, abusive, harmful, competitive, exploitative, infringing, disruptive, or inconsistent with these Terms of Service.
You agree not to:
- Use the website or services in violation of any law, rule, regulation, ordinance, or court order.
- Use the website or services to commit fraud, payment abuse, chargeback abuse, identity theft, unauthorized access, scraping, data harvesting, resale schemes, or ticket fraud.
- Interfere with, disrupt, damage, overload, disable, impair, or compromise the website, systems, servers, networks, security features, or user experience.
- Use bots, crawlers, scrapers, spiders, automated tools, artificial intelligence agents, data extraction tools, or similar methods to access, copy, monitor, harvest, index, train on, or exploit the website, content, listings, ticket inventory, member information, event information, pricing, or data without 8PG’s prior written permission.
- Reverse engineer, decompile, disassemble, copy, modify, frame, mirror, reproduce, distribute, or commercially exploit any part of the website or services.
- Attempt to bypass access controls, membership controls, age gates, ticketing systems, checkout limits, security measures, rate limits, or technological protections.
- Upload, transmit, or distribute viruses, malware, spyware, tracking tools, malicious code, corrupted files, or harmful software.
- Impersonate 8PG, an 8PG representative, another member, another attendee, a vendor, a sponsor, a creator, or any other person or entity.
- Use the website or services to harass, threaten, abuse, defame, stalk, intimidate, exploit, discriminate against, or harm any person.
- Use 8PG content, marks, materials, or event information for unauthorized commercial purposes.
7. User-Generated Content
You may be able to submit, upload, post, tag, display, transmit, message, review, comment, share, or otherwise provide content in connection with the website, events, social media, forms, surveys, communications, sponsor activations, vendor interactions, or other 8PG services.
“User Content” includes text, images, photographs, videos, audio, comments, testimonials, reviews, social media tags, direct messages, posts, survey responses, feedback, ideas, concepts, proposals, creative materials, and any other content you provide to 8PG or post in connection with 8PG.
You represent and warrant that your User Content:
- Is accurate to the best of your knowledge.
- Does not violate any law.
- Does not infringe, misappropriate, or violate any intellectual property, privacy, publicity, contractual, or other rights.
- Does not contain unlawful, defamatory, harassing, abusive, obscene, threatening, hateful, discriminatory, violent, exploitative, fraudulent, or misleading material.
- Does not contain malware, spyware, tracking code, or harmful software.
- Does not disclose private information about another person without authorization.
- Does not falsely imply endorsement, sponsorship, affiliation, or approval by 8PG.
You grant 8PG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable, non-exclusive license to use, reproduce, copy, modify, adapt, publish, translate, distribute, display, perform, create derivative works from, commercialize, promote, and otherwise exploit User Content in any media or format now known or later developed, for any lawful business, marketing, promotional, operational, archival, legal, safety, or commercial purpose, without compensation, notice, inspection, approval, or attribution to you.
8PG may remove, edit, refuse, restrict, disable, or delete User Content at any time and for any reason, but has no obligation to monitor User Content.
You are solely responsible for your User Content and any consequences of posting, sharing, submitting, or transmitting it.
8. Social Media Conduct
Members, guests, attendees, vendors, sponsors, exhibitors, creators, and users are encouraged to engage with 8PG’s social media profiles in a respectful and lawful manner.
You may not post, tag, upload, share, comment, message, or distribute content connected to 8PG that is unlawful, abusive, threatening, obscene, harassing, defamatory, discriminatory, invasive of privacy, misleading, infringing, harmful, unsafe, or inconsistent with 8PG’s brand, event rules, safety standards, or community expectations.
8PG may remove, hide, report, restrict, block, or request removal of content that violates these Terms of Service, infringes 8PG rights, violates platform rules, compromises event safety, reveals confidential information, misrepresents 8PG, harms the 8PG brand, or violates the rights of others.
You may not use 8PG events, venues, guests, members, vendors, sponsors, or content for unauthorized commercial media, press, advertising, monetized content, paid promotion, product placement, or brand campaigns without 8PG’s prior written approval.
9. Event Registration, Ticketing, and Access
Event details, access instructions, registration procedures, ticketing terms, arrival requirements, prohibited items, venue rules, safety rules, and event-specific terms may be released through 8PG’s website, platform, emails, SMS messages, ticketing pages, member communications, or other official 8PG channels.
Event access may be limited by membership status, age, capacity, venue restrictions, ticket type, RSVP status, credential type, VIP status, judge status, sponsor status, vendor status, guest list status, safety determinations, or other eligibility criteria.
A ticket, RSVP, credential, wristband, badge, QR code, pass, confirmation, membership approval, invitation, or guest list placement is a limited, revocable license to seek entry to a specific event or experience. It is not a property right, ownership right, guaranteed admission right, or unrestricted right of access.
8PG may deny entry, delay entry, revoke access, remove any person, void tickets, cancel credentials, restrict access areas, or refuse service at any time for any reason not prohibited by law, including safety, capacity, security, intoxication, misconduct, suspected fraud, underage access attempts, noncompliance with event rules, violation of these Terms of Service, violation of the Membership Agreement, or failure to follow instructions from 8PG staff, venue staff, or security.
Admission is subject to compliance with all posted and communicated event rules.
10. Conspicuous Checkout, Purchase, and Event Assent
Before completing a purchase, RSVP, membership activation, access request, ticket purchase, VIP upgrade, judge kit purchase, vendor registration, sponsor registration, exhibitor registration, or event check-in, 8PG may require you to affirmatively agree to applicable legal terms through unchecked checkboxes, electronic signatures, clickwrap prompts, checkout notices, ticketing notices, waiver forms, or other assent mechanisms.
The applicable checkout, RSVP, registration, ticketing, or event-entry flow may require express agreement to:
- These Terms of Service.
- The locked 8PG Privacy Policy.
- The 8PG Membership Agreement.
- Any applicable Event Terms.
- Any applicable Waiver and Release.
- Any applicable Assumption of Risk.
- The Media Release.
- The No-Refund and Final Sale Policy.
- The Chargeback and Payment Dispute Policy.
- Any posted event rules.
- Any venue-specific rules.
- Any cannabis, hemp, age-restricted, or safety disclosures.
You agree that such electronic assent is valid, binding, and enforceable to the fullest extent permitted by law.
If any checkout, ticketing page, registration page, event page, or confirmation page displays no-refund, final sale, waiver, release, chargeback, event-risk, media-release, age-restricted, or access-control language, those disclosures are incorporated into these Terms of Service and apply in addition to this document.
11. Ticket Transfers, Resale, Scalping, and Fraud
Tickets, passes, credentials, wristbands, badges, QR codes, guest list placements, VIP upgrades, judge access, membership benefits, and event access rights may not be resold, auctioned, transferred, assigned, brokered, bartered, raffled, duplicated, screenshot-sold, bundled, commercially exploited, or used for unauthorized promotions without 8PG’s prior written permission.
Unauthorized resale or transfer may result in voided access, denied entry, removal from the event, forfeiture of payment, cancellation of membership, suspension of account privileges, permanent ban, and any other remedies available to 8PG.
8PG is not responsible for counterfeit tickets, duplicate tickets, copied QR codes, unauthorized screenshots, unauthorized transfers, third-party resale purchases, fraudulent listings, lost credentials, stolen credentials, or access obtained outside official 8PG channels.
If multiple persons present the same or duplicate ticket, credential, QR code, or access pass, 8PG may admit only the first valid scan or may deny access to all disputed users in its discretion.
12. Event Rules and Prohibited Items
8PG events are private, access-controlled experiences. All guests and attendees must comply with event rules, venue rules, staff instructions, security instructions, posted notices, and applicable law.
Unless expressly authorized in writing by 8PG, you may not bring or possess the following at any 8PG event: alcohol, weapons of any kind, firearms, ammunition, knives, explosives, fireworks, drones, unauthorized entertainment equipment, unauthorized vending materials, items intended for sale or distribution, counterfeit goods, illegal substances, open flames, hazardous materials, large bags or items prohibited by venue rules, professional camera, audio, video, lighting, livestreaming, or production equipment intended for commercial use, or any item 8PG, venue staff, or security determines may create a safety, legal, operational, brand, or guest-experience concern.
8PG may prohibit additional items on an event-specific basis.
Possession of prohibited items may result in denial of entry, confiscation where permitted by law, requirement to remove the item from the venue, removal from the event, forfeiture of access, suspension of membership, permanent ban, or referral to law enforcement.
13. Security Screening and Searches
As a condition of entry, attendance, participation, or continued presence at any 8PG event, you consent to reasonable security screening, which may include bag checks, ID checks, credential checks, age verification, metal detector screening, visual inspection, access verification, pat-downs where lawful and appropriate, and other reasonable security measures.
You may refuse screening, but refusal may result in denial of entry or removal without refund or credit to the fullest extent permitted by law.
8PG, venue operators, and security personnel may deny entry or remove any person whose conduct, condition, possession of items, refusal to comply, or other circumstances present a safety, security, legal, operational, or brand concern.
14. Code of Conduct
8PG is committed to maintaining a respectful, inclusive, safe, private, and elevated environment for members, guests, vendors, sponsors, staff, and attendees.
You agree not to engage in:
- Harassment.
- Bullying.
- Threats.
- Violence.
- Discrimination.
- Stalking.
- Unwanted touching.
- Sexual misconduct.
- Aggressive behavior.
- Disorderly conduct.
- Unsafe conduct.
- Intoxicated or impaired conduct that creates risk.
- Theft.
- Vandalism.
- Trespass.
- Unauthorized access to restricted areas.
- Unauthorized vending.
- Unauthorized filming for commercial purposes.
- Disruption of event operations.
- Misuse of cannabis, hemp, alcohol, or other substances.
- Violation of staff, security, venue, or legal instructions.
- Conduct that damages the reputation, safety, privacy, property, or experience of 8PG, its members, guests, vendors, sponsors, venues, or staff.
8PG may remove, suspend, ban, or report any person who violates this Code of Conduct, without refund or credit to the fullest extent permitted by law.
After removal, you must leave the venue and surrounding private property immediately. Refusal to leave after removal may constitute trespass and may result in law enforcement involvement.
15. Cannabis, Hemp, Intoxication, and Age-Restricted Environments
8PG events and experiences may include cannabis culture, cannabis-adjacent products, hemp-derived products, accessories, educational materials, sponsors, vendors, exhibitors, private lounges, demonstrations, product displays, giveaways, or age-restricted subject matter.
Cannabis, hemp, and related laws vary by jurisdiction and may change. You are solely responsible for understanding and complying with all laws applicable to your possession, use, consumption, transportation, purchase, transfer, receipt, or interaction with any cannabis, hemp, product, sample, gift, giveaway, accessory, vendor, sponsor, or exhibitor.
Nothing provided by 8PG constitutes medical advice, legal advice, therapeutic advice, dosing advice, consumption advice, product safety advice, or a recommendation to use, consume, purchase, possess, transport, or combine any product or substance.
8PG makes no representation or warranty regarding the legality, potency, effects, safety, ingredients, quality, testing, labeling, compliance, authenticity, availability, suitability, or fitness of any product, sample, giveaway, gift, item, display, demonstration, or third-party offering provided, sold, promoted, displayed, gifted, sampled, described, or made available by any vendor, sponsor, exhibitor, attendee, or third party.
You agree that any consumption, possession, use, purchase, receipt, or interaction with cannabis, hemp, food, beverage, supplements, products, accessories, samples, gifts, or third-party offerings is voluntary and at your own risk.
8PG may deny entry, remove, or refuse service to any person who appears intoxicated, impaired, unsafe, noncompliant, disruptive, underage, or otherwise unfit to participate safely.
16. California, New York, and State-Specific Cannabis or Hemp Compliance
8PG may operate, promote, host, or support events in multiple jurisdictions, including California, New York, and other states. Cannabis, hemp, intoxicating hemp, cannabinoids, accessories, sampling, gifting, demonstrations, consumption, advertising, sponsorship, product display, and event participation rules may differ by state, county, city, venue, license type, and product category.
You are solely responsible for complying with the laws applicable to you before, during, and after any 8PG event, including laws relating to age, possession, transportation, consumption, impairment, driving, purchase, receipt, sharing, gifting, transfer, and use.
8PG does not guarantee that any product, sample, vendor activity, sponsor activation, hemp-derived product, cannabis-adjacent item, accessory, demonstration, or event practice is lawful for every person in every jurisdiction.
8PG may change, restrict, remove, suspend, relocate, or cancel any cannabis-related, hemp-related, vendor, sponsor, sampling, product-display, lounge, or consumption-adjacent feature at any time to comply with venue requirements, state law, local law, permit restrictions, regulator guidance, safety concerns, insurance requirements, or legal advice.
No event description, vendor listing, sponsor mention, product reference, strain reference, sample reference, menu reference, gift reference, or marketing material should be interpreted as legal advice, medical advice, consumption advice, product endorsement, or a guarantee that a product or activity is lawful, available, safe, tested, effective, or suitable for you.
17. Food, Beverage, Allergies, and Catering
Food, beverages, snacks, samples, infused or non-infused items, catered items, vendor items, sponsor items, gifts, or hospitality offerings may be provided by independent third parties.
8PG does not guarantee that any food, beverage, sample, or consumable item is free from allergens, contaminants, cross-contact, mislabeling, spoilage, or other risks.
You are solely responsible for reviewing ingredients, asking questions, avoiding allergens, managing dietary restrictions, and making safe consumption decisions.
8PG is not responsible for allergic reactions, foodborne illness, adverse reactions, contamination, mislabeling, dietary issues, or third-party food or beverage claims to the fullest extent permitted by law.
18. Parking, Valet, Shuttle, Transportation, and Rideshare
8PG may provide, arrange, suggest, coordinate, communicate about, or facilitate parking, valet, shuttle, rideshare, transportation, offsite parking, pickup/drop-off areas, or related logistics.
Such services may be operated by independent third parties, venues, parking operators, valet providers, shuttle providers, rideshare companies, transportation companies, contractors, or municipalities.
You are solely responsible for your transportation choices, timing, conduct, belongings, vehicle, personal safety, and compliance with all transportation, traffic, parking, rideshare, shuttle, and venue rules.
8PG is not responsible for vehicle damage, theft, lost property, towing, parking tickets, accidents, delays, shuttle incidents, valet incidents, rideshare incidents, transportation provider conduct, or third-party transportation claims to the fullest extent permitted by law.
19. Event Changes, Availability, and Force Majeure
All events, schedules, venues, experiences, activations, vendors, sponsors, exhibitors, performers, speakers, artists, hosts, talent, menus, giveaways, samples, products, benefits, layouts, access areas, capacity, transportation plans, entry times, and programming are subject to change without notice.
8PG does not guarantee the appearance, availability, participation, performance, schedule, timing, quantity, or quality of any vendor, sponsor, exhibitor, performer, artist, host, talent, activation, giveaway, product, sample, benefit, or experience.
8PG may cancel, postpone, reschedule, relocate, modify, shorten, extend, suspend, or terminate any event or offering due to weather, fire, flood, earthquake, natural disaster, emergency, power outage, venue issue, government action, permit issue, law enforcement issue, public health issue, labor issue, transportation disruption, vendor failure, sponsor failure, security concern, safety concern, technical failure, utility failure, terrorism, civil unrest, war, epidemic, pandemic, acts of God, or any other circumstance beyond 8PG’s reasonable control.
Unless otherwise required by law or expressly stated in writing by 8PG, event changes, schedule changes, vendor changes, sponsor changes, talent changes, venue changes, weather, delays, access limitations, partial event closures, or changes in programming do not entitle you to a refund, credit, chargeback, cancellation, or damages.
20. Purchases, Final Sales, Refunds, and Cancellations
All purchases are final to the fullest extent permitted by law, including tickets, event access, memberships, deposits, VIP upgrades, judge kits, merchandise, digital goods, access passes, sponsorships, vendor fees, exhibitor fees, and other event-related purchases.
Unless 8PG expressly states otherwise in writing or applicable law requires otherwise, purchases are non-refundable, non-cancellable, non-returnable, non-transferable, and not redeemable for cash.
No-refund, final-sale, no-cancellation, no-transfer, chargeback, waiver, and access-control terms may also be displayed at checkout, on ticket pages, on event pages, in purchase confirmations, in registration flows, in waiver forms, or at event check-in. Any such disclosures are incorporated into these Terms of Service and are intended to be conspicuous, binding, and enforceable to the fullest extent permitted by law.
Failure to attend an event, late arrival, denial of entry, removal for misconduct, inability to verify age or identity, failure to follow rules, weather, schedule changes, venue changes, dissatisfaction, failure to use benefits, or failure to redeem access does not entitle you to a refund or credit.
8PG may, in its sole discretion, issue credits, substitutions, accommodations, or exceptions in specific cases, but doing so does not create any obligation to do so in the future and does not waive 8PG’s rights.
21. Chargebacks, Payment Disputes, and Payment Abuse
You agree to contact 8PG first at info@8pgevents.com before initiating any payment dispute, chargeback, ACH reversal, card dispute, processor claim, platform dispute, or similar reversal request.
To the fullest extent permitted by law, you agree not to initiate a chargeback or payment reversal for any purchase that was authorized by you or anyone using your account, payment method, email address, phone number, billing address, shipping address, membership profile, device, or credentials, except in cases of true unauthorized payment fraud.
A chargeback, ACH reversal, payment dispute, processor claim, or similar reversal initiated after ticket delivery, digital delivery, event attendance, membership use, benefit redemption, shipment, access grant, credential issuance, RSVP confirmation, or use of any 8PG service may constitute material breach of these Terms of Service and may result in immediate suspension, termination, cancellation of tickets, revocation of credentials, removal from guest lists, cancellation of membership, denial of future purchases, denial of future event access, blacklisting of associated accounts, and any other remedies available to 8PG.
8PG may submit evidence to payment processors, banks, card networks, fraud-prevention vendors, ticketing platforms, and dispute-resolution systems, including transaction records, IP addresses, device data, communications, checkout assent records, delivery records, attendance records, scan records, membership records, event access logs, benefit redemption records, security records, and other relevant information.
To the fullest extent permitted by law, you are responsible for the original transaction amount, chargeback fees, processor fees, bank fees, penalties, administrative costs, investigation costs, collection costs, attorneys’ fees, arbitration costs, court costs, and any other damages or costs incurred by 8PG in connection with improper payment disputes, payment abuse, friendly fraud, chargeback abuse, or collection of unpaid amounts.
8PG may send unpaid balances to collections, pursue arbitration, pursue court remedies where permitted, seek injunctive relief, report fraud, and take any lawful enforcement action available.
22. Merchandise, Products, Digital Goods, Shipping, and Delivery
8PG may offer merchandise, apparel, accessories, digital goods, memberships, tickets, credentials, event-related products, sponsor-related products, or other items.
Unless expressly stated otherwise in writing, all products and merchandise are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, condition, quality, availability, or suitability.
Product images, colors, sizing, descriptions, availability, packaging, and details may vary. 8PG does not guarantee that products will appear exactly as displayed.
You are responsible for providing accurate shipping, delivery, and contact information. 8PG is not responsible for failed delivery, lost packages, stolen packages, misdelivered packages, incorrect addresses, refused shipments, carrier delays, customs issues, weather delays, or third-party carrier conduct to the fullest extent permitted by law.
Risk of loss may pass to you when an item is delivered to the carrier or delivery provider, to the fullest extent permitted by applicable law.
23. Third-Party Vendors, Sponsors, Exhibitors, Performers, Platforms, and Providers
8PG events and services may involve independent third parties, including vendors, sponsors, exhibitors, performers, artists, hosts, creators, influencers, caterers, valet providers, shuttle providers, venues, security providers, production companies, payment processors, ticketing platforms, merchandise providers, delivery providers, and technology providers.
Third parties are independent and are not employees, agents, partners, joint venturers, or representatives of 8PG unless expressly stated in writing by 8PG.
8PG is not responsible for third-party products, services, statements, claims, conduct, omissions, pricing, samples, giveaways, defects, injuries, representations, warranties, advertising, compliance, or legal obligations to the fullest extent permitted by law.
Your interactions with third parties are solely between you and the third party, unless expressly stated otherwise in writing.
24. Vendor, Sponsor, and Exhibitor Compliance Requirements
Any vendor, sponsor, exhibitor, brand, promoter, caterer, service provider, or third party participating in an 8PG event is solely responsible for its own legal compliance, licensing, permits, insurance, products, services, claims, staff, booth operations, marketing materials, product descriptions, samples, giveaways, demonstrations, sales, taxes, safety practices, and interactions with guests.
Vendors, sponsors, exhibitors, and participating third parties must comply with all applicable federal, state, and local laws, venue requirements, insurance requirements, event rules, product rules, advertising rules, cannabis or hemp regulations, food and beverage regulations, age-restricted product rules, employment rules, and safety requirements.
8PG may require vendors, sponsors, exhibitors, and participating third parties to sign separate written agreements containing indemnity, insurance, compliance, product liability, booth conduct, intellectual property, confidentiality, payment, and operational obligations. Those separate agreements are intended to provide 8PG additional protection and do not limit any rights or remedies available under these Terms of Service.
8PG may remove, restrict, or terminate any vendor, sponsor, exhibitor, activation, product display, sample, giveaway, booth, staff member, or third-party activity that 8PG determines may create legal, safety, compliance, brand, guest-experience, operational, or reputational risk.
25. Being Photographed, Filmed, Recorded, and Publicity Rights
By attending, entering, participating in, or remaining at any 8PG event, venue, activation, lounge, hospitality area, parking area, shuttle area, check-in area, vendor area, sponsor area, or related space, you consent to being photographed, filmed, livestreamed, recorded, captured, and otherwise documented by 8PG, its media teams, venue operators, sponsors, vendors, exhibitors, partners, attendees, creators, or other third parties.
You grant 8PG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable right and license to use, reproduce, display, distribute, edit, publish, broadcast, stream, post, advertise, promote, commercialize, and otherwise exploit your name, image, likeness, voice, appearance, performance, statements, social media handle, biographical information, and event participation in any media now known or later developed, including websites, social media, advertisements, recap videos, press materials, sponsor decks, investor decks, internal materials, event promotions, and future marketing, without compensation, notice, inspection, approval, or attribution.
You waive any claims based on right of publicity, right of privacy, false light, defamation, misappropriation, moral rights, approval rights, compensation rights, or similar rights arising from lawful use of event media to the fullest extent permitted by law.
If you do not want to be photographed, filmed, or recorded, do not attend 8PG events.
26. Communications, Email, SMS, and Consent
By providing your email address, phone number, or other contact information, you consent to receive transactional, operational, event-related, membership-related, legal, safety, customer service, and, where consent is provided, marketing communications from 8PG and its service providers.
Communications may include membership updates, event announcements, ticketing and access updates, guest list confirmations, security notices, safety notices, weather notices, parking notices, transportation notices, schedule notices, venue notices, purchase confirmations, customer service messages, newsletters, sponsor announcements, abandoned checkout reminders, VIP communications, and access-related communications.
By opting into SMS marketing communications, you agree to receive recurring automated and non-automated promotional text messages from 8PG at the phone number provided. Consent to receive marketing text messages is not a condition of purchase. Message frequency may vary. Message and data rates may apply. You may opt out of SMS marketing messages at any time by replying STOP. For help, reply HELP or contact info@8pgevents.com.
You may opt out of marketing emails using the unsubscribe link in marketing emails or by contacting info@8pgevents.com. Even if you opt out of marketing communications, 8PG may continue sending non-marketing transactional, legal, operational, safety, account, membership, purchase, and event-access communications where permitted by law.
27. Intellectual Property
The website, content, designs, graphics, layouts, photographs, videos, text, copy, software, source code, databases, event names, brand names, logos, trademarks, service marks, trade dress, slogans, artwork, membership materials, event materials, ticketing materials, judge materials, VIP materials, sponsor materials, and all related intellectual property are owned by 8PG or its licensors and are protected by law.
8PG remains the sole and exclusive owner of all 8PG trademarks, service marks, logos, names, products, services, event names, brand elements, designs, and related intellectual property, including all related goodwill.
You may not use, copy, reproduce, modify, distribute, display, sell, resell, print, manufacture, counterfeit, create derivative works from, register, imitate, or exploit any 8PG intellectual property without 8PG’s prior written permission.
Unauthorized use of 8PG intellectual property may result in removal from an event, cancellation of access, suspension or termination of membership, permanent ban from future 8PG events, legal action, injunctive relief, damages, attorneys’ fees, and any other remedies available to 8PG.
If unauthorized materials or goods bearing 8PG marks or intellectual property are brought to an event, 8PG may require immediate removal of those materials, deny entry, remove the responsible person, preserve evidence, request surrender where lawful, contact law enforcement where appropriate, and pursue all available remedies. Nothing in these Terms of Service limits 8PG’s rights under trademark, copyright, unfair competition, counterfeiting, or other applicable laws.
28. Confidentiality and Private Event Information
Certain 8PG events, venues, addresses, guest lists, member lists, schedules, access instructions, private communications, VIP areas, judge materials, sponsor information, vendor information, internal operations, and event details may be confidential or access-controlled.
You may not disclose, publish, sell, transfer, post, scrape, harvest, share, leak, or commercially exploit confidential or private 8PG information without prior written authorization.
8PG may revoke access, suspend membership, remove attendees, ban users, or pursue legal remedies for unauthorized disclosure or misuse of confidential or private event information.
29. Accessibility and Accommodation Requests
8PG aims to operate events and services in a manner consistent with applicable accessibility laws.
If you require a reasonable accommodation, you must contact 8PG as early as possible at info@8pgevents.com with sufficient information to allow review and coordination. Accommodation requests are evaluated on a case-by-case basis.
8PG does not guarantee that every venue, activation, outdoor area, private property, historic property, parking area, shuttle area, pool area, lounge, stage, or event feature will be fully accessible in every respect, but 8PG will make legally required reasonable accommodations where applicable and feasible.
30. Separate Waiver and Event-Entry Release
Because 8PG events may involve private venues, outdoor areas, pools, stairs, crowds, transportation, security screening, cannabis-adjacent environments, third-party vendors, food, beverages, sponsor activations, and other elevated-risk conditions, 8PG may require you to sign or electronically accept a separate Waiver and Release, Assumption of Risk, Media Release, event-entry agreement, or venue-specific release before allowing entry or participation.
Any separate waiver, release, assumption-of-risk document, event-entry agreement, posted event notice, or check-in acknowledgment is incorporated into these Terms of Service by reference and applies in addition to the assumption of risk, release, indemnity, and limitation of liability provisions below.
Refusal to sign or electronically accept a required waiver, release, assumption-of-risk document, event-entry agreement, or event notice may result in denial of entry, removal, cancellation of access, or forfeiture of event participation rights without refund or credit to the fullest extent permitted by law.
31. Assumption of Risk
You understand and agree that attendance at private events, venues, lounges, activations, hospitality areas, pools, outdoor areas, parking areas, shuttle areas, valet areas, sponsor areas, vendor areas, and access-controlled environments involves inherent, foreseeable, and unforeseeable risks.
Risks may include, without limitation: slip, trip, and fall risks; pool, spa, water, deck, and wet surface risks; stair, balcony, railing, elevation, and uneven surface risks; lighting, sound, crowd, smoke, fog, heat, weather, and visibility risks; parking, valet, shuttle, transportation, rideshare, and traffic risks; security incidents; altercations; theft; lost property; property damage; food, beverage, allergy, and contamination risks; adverse reactions; cannabis, hemp, intoxication, impairment, and overconsumption risks; vendor, sponsor, exhibitor, or third-party product risks; medical emergency risks; outdoor terrain risks; private venue risks; equipment, production, electrical, lighting, audio, staging, and activation risks; and acts or omissions of other attendees, guests, vendors, sponsors, exhibitors, performers, contractors, venue operators, transportation providers, or third parties.
By attending or participating, you knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, arising out of or relating to your attendance, participation, travel, transportation, consumption, interactions, purchases, use of services, or presence at any 8PG event or related location, to the fullest extent permitted by law.
32. Release, Waiver, Covenant Not to Sue, and California Civil Code Section 1542 Waiver
To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, production providers, transportation providers, and related parties from and against any and all claims, demands, causes of action, damages, liabilities, losses, injuries, costs, and expenses arising out of or relating to: website use, membership, event registration, ticket purchase, event attendance, event entry or denial of entry, removal from an event, security screening, age verification, transportation, parking, valet, shuttle use, food or beverage, cannabis, hemp, or related environments, vendor, sponsor, exhibitor, or third-party interactions, products, samples, gifts, giveaways, demonstrations, or activations, media capture, lost property, theft, personal injury, property damage, emotional distress, illness, adverse reaction, schedule changes, venue changes, event cancellation, delay, modification, or relocation, or any other matter connected with 8PG services or events.
This release applies whether claims are known or unknown, suspected or unsuspected, fixed or contingent, accrued or unaccrued, and whether based on contract, tort, negligence, premises liability, strict liability, warranty, statute, equity, or any other legal theory, except to the extent such claims cannot be released under applicable law.
If you are a California resident or if California law applies, you expressly waive the protections of California Civil Code Section 1542, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
You understand and agree that this waiver means you may be releasing claims that you do not currently know or suspect to exist. You knowingly, voluntarily, and expressly assume that risk.
Nothing in these Terms of Service is intended to release claims that cannot legally be waived, including claims for gross negligence, willful misconduct, intentional injury, fraud, or statutory rights that cannot be waived as a matter of law.
33. Indemnification
You agree to defend, indemnify, and hold harmless 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, production providers, transportation providers, and related parties from and against any claims, demands, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your use of the website or services.
- Your membership.
- Your event attendance.
- Your conduct.
- Your User Content.
- Your violation of these Terms of Service.
- Your violation of the Membership Agreement or event rules.
- Your violation of law.
- Your violation of another person’s rights.
- Your fraud, payment abuse, chargeback abuse, or misrepresentation.
- Your unauthorized use of 8PG intellectual property.
- Your unauthorized resale or transfer of tickets, credentials, or access.
- Your possession, use, consumption, transfer, purchase, or transportation of any product or substance.
- Your interactions with other guests, vendors, sponsors, exhibitors, or third parties.
- Your acts or omissions that cause injury, damage, loss, dispute, investigation, enforcement action, or claim.
8PG may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with 8PG’s defense. You may not settle any claim without 8PG’s prior written consent.
34. Disclaimer of Warranties
The website, services, events, memberships, tickets, credentials, content, communications, merchandise, digital goods, access, benefits, products, and all related offerings are provided “as is,” “as available,” and “with all faults” to the fullest extent permitted by law.
8PG disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, quiet enjoyment, safety, legality, suitability, uninterrupted service, error-free operation, and any warranties arising from course of dealing, course of performance, or usage of trade.
8PG does not warrant that: the website will be uninterrupted, secure, timely, or error-free; events will occur as scheduled; vendors, sponsors, exhibitors, performers, products, samples, or benefits will be available; any event will meet your expectations; any product, sample, gift, giveaway, or third-party item will be safe, legal, effective, authentic, available, or suitable for you; any content, communication, or information will be accurate, complete, or current; or any defect, error, or issue will be corrected.
35. Limitation of Liability
To the fullest extent permitted by law, 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, production providers, transportation providers, and related parties will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, or similar damages, including lost profits, lost revenue, lost business, lost opportunity, lost data, loss of goodwill, emotional distress, reputational harm, personal inconvenience, substitute services, or other intangible losses.
To the fullest extent permitted by law, 8PG’s total cumulative liability for all claims arising out of or relating to these Terms of Service, the website, services, membership, purchases, tickets, event access, event attendance, merchandise, communications, or any related matter will not exceed the greater of:
- The amount you paid directly to 8PG for the specific product, service, membership, ticket, event, or transaction giving rise to the claim during the 12 months before the claim arose; or
- One hundred dollars.
This limitation applies regardless of the legal theory, whether based on contract, tort, negligence, premises liability, strict liability, warranty, statute, equity, or otherwise, even if 8PG has been advised of the possibility of damages.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.
36. Dispute Resolution; Informal Resolution Required
Before filing any arbitration, lawsuit, chargeback, payment dispute, agency complaint, or other formal claim, you agree to first contact 8PG at info@8pgevents.com with a written notice describing the dispute, the facts, your requested resolution, your contact information, and any supporting documentation.
You and 8PG agree to attempt in good faith to resolve the dispute informally for at least 30 days after 8PG receives your written notice, unless immediate action is required to prevent irreparable harm, protect intellectual property, protect safety, prevent fraud, enforce access restrictions, collect unpaid amounts, or comply with legal obligations.
37. Binding Arbitration Agreement
To the fullest extent permitted by law, you and 8PG agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms of Service, the website, services, membership, purchases, tickets, event access, event attendance, communications, merchandise, User Content, privacy, media rights, payment disputes, chargebacks, or any relationship with 8PG will be resolved by final and binding individual arbitration, rather than in court.
The arbitration will be administered by JAMS under the JAMS rules applicable to the dispute, including the JAMS Streamlined Arbitration Rules and Procedures, JAMS Comprehensive Arbitration Rules and Procedures, or JAMS Consumer Arbitration Minimum Standards, as applicable. If JAMS is unavailable, unwilling, unable to administer the arbitration, or cannot administer the arbitration consistent with these Terms of Service, the parties will confer in good faith to select a comparable neutral arbitration provider. If the parties cannot agree, a court of competent jurisdiction may appoint a neutral arbitration provider.
The arbitration will be conducted by a single neutral arbitrator. The seat of arbitration will be Los Angeles County, California, unless applicable law requires otherwise or the arbitrator determines that a different location or remote proceeding is required for fairness or legal compliance.
The arbitrator will have exclusive authority to resolve disputes regarding arbitrability, enforceability, interpretation, scope, formation, validity, and application of this arbitration agreement, except that any dispute regarding the class action waiver, jury trial waiver, representative action waiver, or mass arbitration procedures may be decided by a court of competent jurisdiction.
The arbitrator may award the same individual remedies that a court could award, subject to the limitations, waivers, releases, and caps in these Terms of Service.
Arbitration fees, administrative fees, filing fees, arbitrator compensation, and costs will be allocated in accordance with applicable JAMS rules and applicable law. Nothing in these Terms of Service requires a consumer to pay arbitration fees or costs that would make arbitration unavailable, prohibitively expensive, unconscionable, or unlawful under applicable law. If any fee or cost provision is found unenforceable, it will be modified to the minimum extent necessary to preserve the enforceability of this arbitration agreement while complying with applicable law.
Each party will be responsible for its own attorneys’ fees and costs unless applicable law, these Terms of Service, or the arbitrator permits recovery of fees or costs.
38. Class Action Waiver and Representative Action Waiver
To the fullest extent permitted by law, you and 8PG agree that all disputes must be brought only on an individual basis.
You waive any right to bring, participate in, join, consolidate, or proceed with any class action, collective action, representative action, private attorney general action, mass action, consolidated action, or similar proceeding against 8PG.
The arbitrator may not preside over any class, collective, representative, mass, or consolidated proceeding unless 8PG expressly agrees in writing.
If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request for relief may be severed and brought in court only to the extent required by law, while all remaining claims must proceed in arbitration.
39. Mass Arbitration Procedures
If 25 or more similar arbitration demands are filed against 8PG by or with the assistance of the same law firm, group of law firms, organization, coordinated claimants, or third-party funding source, the demands will be treated as a mass arbitration.
In a mass arbitration, the parties agree that:
- Claims may be batched for staged proceedings.
- No more than 10 demands may proceed to arbitration at one time unless the parties agree otherwise.
- The first batch will be selected randomly or by the arbitration provider.
- Remaining claims will be stayed pending resolution of earlier batches.
- Results from earlier batches may be used to facilitate global mediation or resolution.
- Administrative fees will be assessed in a manner consistent with the arbitration provider’s rules and applicable law.
If any portion of these mass arbitration procedures conflicts with mandatory JAMS rules, consumer arbitration standards, or applicable law, the conflicting portion will be modified to the minimum extent necessary to comply while preserving the parties’ intent to avoid inefficient, duplicative, or coercive mass proceedings.
These procedures are intended to create a fair, efficient, and cost-effective process and must be interpreted to the fullest extent permitted by law.
40. Jury Trial Waiver
To the fullest extent permitted by law, you and 8PG knowingly and voluntarily waive any right to a trial by jury in any dispute, claim, or proceeding arising out of or relating to these Terms of Service, the website, services, membership, purchases, tickets, events, communications, or any relationship with 8PG.
41. Small Claims, Injunctive Relief, and Exceptions
Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
8PG may seek injunctive or equitable relief in court for claims involving intellectual property, unauthorized use of 8PG marks, confidential information, unauthorized access, fraud, chargeback abuse, trespass, safety threats, harassment, event disruption, nonpayment, or any conduct that may cause irreparable harm.
Nothing in these Terms of Service prevents either party from reporting matters to law enforcement, regulators, or government agencies.
42. Governing Law and Venue
These Terms of Service are governed by the laws of the State of California, without regard to conflict of law principles, except where federal law preempts California law or where applicable law requires otherwise.
Subject to the arbitration agreement above, any court proceeding that is not subject to arbitration must be brought in the state or federal courts located in Los Angeles County, California, unless applicable law requires a different venue.
You consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum or lack of personal jurisdiction, to the fullest extent permitted by law.
43. Time Limit to Bring Claims
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms of Service, the website, services, membership, purchases, tickets, events, communications, or any relationship with 8PG must be filed within one year after the claim accrues, or it is permanently barred.
This limitation does not apply where prohibited by law.
44. Termination, Suspension, and Enforcement
8PG may suspend, terminate, restrict, revoke, or deny your access to the website, membership, account, tickets, credentials, events, purchases, communications, benefits, or services at any time and for any reason not prohibited by law.
Reasons may include: violation of these Terms of Service; violation of the Membership Agreement; violation of event rules; misconduct; fraud; payment abuse; chargeback abuse; unauthorized resale; underage access attempts; safety concerns; security concerns; harassment; damage to 8PG reputation; misuse of 8PG intellectual property; unauthorized commercial activity; noncompliance with staff or security instructions; or any other conduct 8PG determines is inconsistent with its standards, operations, safety, brand, or community.
Termination or suspension does not waive any rights or remedies 8PG may have and does not entitle you to a refund unless required by law.
45. Electronic Assent and Communications
You agree that electronic signatures, checkboxes, clickwraps, account registration, checkout acceptance, RSVP acceptance, ticket purchase, event registration, continued website use, and event attendance constitute valid and binding acceptance of these Terms of Service.
You consent to receive legal, transactional, operational, event, membership, purchase, and account communications electronically, including by email, SMS, website notice, account notice, checkout notice, or other electronic means.
You agree that electronic records satisfy any legal requirement that communications or records be in writing, to the fullest extent permitted by law.
46. Assignment
You may not assign, transfer, delegate, or sublicense these Terms of Service or any rights or obligations under them without 8PG’s prior written consent.
8PG may assign, transfer, delegate, or sublicense these Terms of Service, in whole or in part, at any time, including in connection with a merger, acquisition, restructuring, financing, sale of assets, transfer of business operations, or by operation of law.
47. No Waiver
No failure or delay by 8PG in exercising any right, power, remedy, or privilege under these Terms of Service will operate as a waiver.
No waiver will be effective unless in writing and signed by an authorized representative of 8PG.
A waiver of any breach does not waive any other or later breach.
48. Severability and Reformation
If any provision of these Terms of Service is found invalid, illegal, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and modified or reformed to the minimum extent necessary to make it valid and enforceable.
If modification or reformation is not permitted, the unenforceable provision will be severed, and the remaining provisions will remain in full force and effect.
The parties intend that every provision be interpreted to provide 8PG the maximum lawful protection permitted by applicable law.
49. Survival
Any provision that by its nature should survive termination, expiration, cancellation, event completion, account closure, membership termination, or discontinued use will survive, including provisions relating to intellectual property, User Content licenses, media releases, payment obligations, chargebacks, disclaimers, assumption of risk, releases, indemnification, limitation of liability, dispute resolution, arbitration, class action waiver, governing law, confidentiality, and enforcement.
50. Entire Agreement
These Terms of Service, together with the locked 8PG Privacy Policy, Membership Agreement, event-specific terms, waiver terms, purchase terms, ticket terms, posted event rules, checkout disclosures, and any additional terms expressly incorporated by reference, constitute the entire agreement between you and 8PG regarding the subject matter covered by these Terms of Service.
They supersede all prior or contemporaneous understandings, communications, representations, or agreements regarding the same subject matter, whether oral or written, except for separate written agreements signed by 8PG that expressly state they supersede these Terms of Service.
51. Acknowledgment of Material Terms
By accessing the website, applying for membership, purchasing access, purchasing a ticket, registering for an event, RSVPing, accepting a credential, entering an event venue, attending an event, participating in an 8PG experience, submitting information, checking any box indicating agreement, or using any 8PG service, you expressly acknowledge and agree that:
- You are at least 21 years of age unless a specific non-age-restricted offering expressly states otherwise.
- Your access to any 8PG event is a limited, revocable license and not a property right.
- 8PG may deny entry, remove you, revoke access, suspend membership, or ban you for safety, security, misconduct, fraud, underage access attempts, payment abuse, rule violations, or any other reason not prohibited by law.
- All purchases are final, non-refundable, non-cancellable, non-returnable, and non-transferable to the fullest extent permitted by law.
- You must contact 8PG before initiating any chargeback, payment dispute, ACH reversal, card dispute, processor claim, or similar payment reversal.
- Improper chargebacks or payment disputes may result in revocation of access, cancellation of membership, denial of future purchases, blacklisting, collection efforts, fee recovery, and legal enforcement to the fullest extent permitted by law.
- You assume all known and unknown risks connected with private events, venues, pools, stairs, crowds, transportation, valet, parking, security screening, cannabis-adjacent environments, hemp-related environments, food, beverages, vendors, sponsors, exhibitors, products, samples, activations, and third-party conduct.
- You release and waive claims against 8PG and related parties to the fullest extent permitted by law, including unknown claims where legally waivable.
- You grant 8PG broad rights to photograph, film, record, livestream, publish, advertise, and commercially use your name, image, likeness, voice, appearance, statements, and event participation without compensation, notice, inspection, or approval.
- You agree to the limitation of liability, damages exclusions, indemnification obligations, arbitration agreement, class action waiver, representative action waiver, jury trial waiver, governing law, venue, and one-year claim limitation stated in these Terms of Service.
- You understand that cannabis, hemp, age-restricted products, third-party vendor products, sponsor activations, samples, gifts, giveaways, food, beverages, and event experiences may involve legal, physical, personal, health, safety, reputational, and financial risks, and that you are solely responsible for your own legal compliance and personal decisions.
- You have had the opportunity to read these Terms of Service, the locked 8PG Privacy Policy, the Membership Agreement, any applicable event terms, purchase terms, waiver terms, and posted rules before using 8PG services or attending an event.
