Membership Agreement
This Membership Agreement, together with any documents, policies, rules, notices, waivers, purchase terms, event terms, ticket terms, membership terms, codes of conduct, posted rules, checkout disclosures, registration terms, venue rules, and additional terms expressly incorporated by reference, forms a legally binding agreement between you and 8PG.
For purposes of this Membership Agreement, “8PG,” “Company,” “we,” “us,” and “our” mean 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, event staff, security personnel, service providers, successors, assigns, affiliates, and authorized designees, as applicable. “You” and “your” mean any member, applicant, prospective member, ticket purchaser, guest, attendee, invitee, vendor, sponsor, exhibitor, performer, contractor, creator, influencer, media participant, purchaser, recipient, user, or other person who applies for membership, obtains membership, uses membership benefits, purchases or receives access, registers for an event, attends an event, interacts with 8PG, or uses any 8PG service.
This Membership Agreement governs your membership with 8PG, your use of membership benefits, your access to membership-related opportunities, your interaction with other members, your event participation, your use of 8pgevents.com and related membership pages, your purchases, your possession or use of access credentials, and your relationship with 8PG as a member or applicant.
Your use of 8PG’s website, services, events, purchases, access passes, and related offerings is also governed by the 8PG Terms of Service, titled “8PGEVENTS.COM - 8PG - TERMS OF SERVICE,” Last Updated April 23, 2026, which is incorporated into this Membership Agreement by reference.
Your privacy is governed by the 8PG Privacy Policy, titled “8PGEVENTS.COM - 8PG - PRIVACY POLICY,” Last Updated April 23, 2026, which is incorporated into this Membership Agreement by reference. The Privacy Policy explains how 8PG collects, uses, discloses, retains, and protects Personal Information, including membership-related, event-related, payment-related, SMS, email, analytics, media, security, age verification, and cannabis-adjacent information.
By applying for membership, creating an account, submitting membership information, checking any box indicating agreement, purchasing access, purchasing merchandise, purchasing a ticket, registering for an event, RSVPing, accepting a credential, using a membership benefit, entering an event venue, attending an 8PG event, participating in an 8PG experience, communicating with 8PG, or accepting any 8PG benefit, you agree to be bound by this Membership Agreement.
If you do not agree to this Membership Agreement, do not apply for membership, use membership benefits, purchase access, register for events, attend events, enter event venues, or use 8PG services.
Important Notice
This Membership Agreement includes important legal terms, including:
- No-refund, final-sale, no-cancellation, and no-chargeback provisions.
- A chargeback and payment dispute policy that may result in loss of membership, loss of access, recovery of fees and costs, collection efforts, and other enforcement remedies.
- A strict event poaching, solicitation, unauthorized promotion, and unfair competition policy that may result in liquidated damages of up to $10,000 per violation where enforceable.
- Immediate removal from events for prohibited conduct, unsafe behavior, unauthorized solicitation, security concerns, or violation of 8PG rules.
- A broad assumption of risk, waiver, release, covenant not to sue, and California Civil Code Section 1542 waiver.
- A broad media, likeness, recording, and publicity release.
- Mandatory individual arbitration through JAMS, class action waiver, representative action waiver, mass arbitration procedures, and jury trial waiver.
- Membership revocation, suspension, termination, denial of future access, account restriction, and event ban rights.
Please read this Membership Agreement carefully.
1. Relationship to Terms of Service, Privacy Policy, Waivers, and Other Terms
This Membership Agreement applies in addition to the locked 8PG Terms of Service and locked 8PG Privacy Policy.
If there is a conflict between this Membership Agreement and the Terms of Service regarding membership status, membership eligibility, membership access, membership conduct, membership benefits, suspension, termination, revocation, poaching, solicitation, member-specific obligations, or membership enforcement, this Membership Agreement controls to the extent of the conflict.
If there is a conflict between this Membership Agreement and event-specific terms, purchase-specific terms, waiver language, posted event rules, checkout disclosures, signed agreements, vendor terms, sponsor terms, exhibitor terms, or venue rules, the more specific terms control to the extent of the conflict.
8PG may require separate affirmative assent to the Terms of Service, Privacy Policy, Membership Agreement, Event Terms, Waiver and Release, Assumption of Risk, No-Refund Policy, Media Release, Chargeback Policy, and any other applicable terms before allowing checkout, RSVP, membership activation, ticket purchase, event entry, VIP access, judge participation, vendor participation, sponsor participation, exhibitor participation, or continued attendance.
All terms, policies, waivers, rules, and agreements are cumulative and intended to provide 8PG the maximum protection permitted by applicable law.
2. Changes to This Membership Agreement
8PG may modify, update, revise, supplement, replace, or amend this Membership Agreement at any time.
Changes are effective when posted on the website or otherwise made available, unless a later effective date is stated. 8PG may notify members of material changes by posting the updated Membership Agreement, updating the “Last Updated” date, sending notice by email or SMS, providing notice at checkout, providing notice during registration, requiring renewed assent, or using any other legally sufficient method.
Your continued membership, account use, access to member benefits, event registration, ticketing activity, event attendance, purchases, communications, or use of 8PG services after an updated Membership Agreement is posted or made available constitutes acceptance of the updated Membership Agreement.
For significant changes, 8PG may require you to expressly re-confirm acceptance before attending future events, purchasing future access, using benefits, or continuing membership activity.
To the extent this Membership Agreement differs from any prior version, this version supersedes and governs your membership and future interactions with 8PG from the effective date forward.
This Membership Agreement does not unlawfully impose new penalties on completed past conduct unless you separately agreed to those terms at the applicable time or unless enforcement is otherwise permitted by law. However, continued membership, continued event attendance, continued use of benefits, continued website use, or continued interaction with 8PG after this Membership Agreement is made available constitutes acceptance of this Membership Agreement for all future membership activity and continuing obligations.
3. Membership Eligibility
Membership is available only to individuals who are at least 21 years of age, unless a specific non-age-restricted offering expressly states otherwise in writing.
By applying for membership, using the website, purchasing access, registering for an event, attending an event, using membership benefits, or interacting with 8PG as a member, you represent and warrant that you are at least 21 years of age and legally permitted to enter into this Membership Agreement.
Proof of age, identity, eligibility, membership status, purchase confirmation, ticket ownership, RSVP confirmation, or other access verification may be required at registration, checkout, check-in, event entry, benefit redemption, or any other time.
8PG may deny membership, deny access, cancel orders, void tickets, revoke credentials, suspend membership, remove attendees, or ban users if age, identity, eligibility, payment, membership, or access requirements cannot be verified to 8PG’s satisfaction.
Attempting to access age-restricted services, membership benefits, events, venues, content, lounges, purchases, samples, vendor areas, sponsor areas, or experiences while underage is strictly prohibited and may result in denial of access, removal, membership suspension, permanent ban, forfeiture of payments, and referral to law enforcement where appropriate.
4. Membership Nature, Benefits, and No Property Rights
Membership is a limited, revocable, personal, non-transferable privilege. Membership is not a property right, ownership interest, equity interest, license to intellectual property, investment, guarantee of access, guaranteed invitation right, contractual right to specific events, or vested entitlement.
8PG currently offers membership registration at no cost unless otherwise disclosed in writing. If 8PG later offers paid memberships, renewals, subscriptions, deposits, upgrades, paid access programs, or recurring services, the applicable pricing, billing, renewal, cancellation, and payment terms will be disclosed at the point of purchase or enrollment.
Membership may provide access to certain opportunities, communications, private events, ticketing opportunities, access-controlled experiences, VIP opportunities, judge programs, sponsor activations, vendor interactions, giveaways, member communications, or other benefits.
All membership benefits, access, invitations, communications, events, VIP opportunities, perks, giveaways, sponsor activations, vendor activations, judge opportunities, early access, private invitations, and related offerings are subject to availability and may be changed, limited, substituted, suspended, revoked, discontinued, or denied at any time to the fullest extent permitted by law.
8PG does not guarantee that any member will receive any specific invitation, event access, ticket opportunity, benefit, perk, giveaway, sample, product, sponsor activation, VIP opportunity, judge opportunity, vendor interaction, or experience.
5. Membership Approval, Denial, Suspension, Revocation, and Termination
8PG may approve, deny, suspend, revoke, terminate, restrict, or refuse membership in its sole discretion for any reason not prohibited by law.
Reasons may include: violation of this Membership Agreement, violation of the Terms of Service, violation of privacy-related consent terms, data misuse rules, confidentiality obligations, account security requirements, communication rules, or applicable privacy or security provisions in this Membership Agreement, the Terms of Service, event terms, checkout terms, or other 8PG policies; violation of event rules; violation of venue rules; safety concerns; security concerns; misconduct; harassment; bullying; threats; violence; discrimination; fraud; payment abuse; chargeback abuse; unauthorized resale; unauthorized solicitation; event poaching; underage access attempts; false information; misuse of 8PG intellectual property; unauthorized commercial activity; violation of cannabis or hemp compliance rules; harm to 8PG’s reputation, brand, members, vendors, sponsors, staff, guests, venues, or community; or any other conduct 8PG determines is inconsistent with its standards, operations, safety, privacy, brand, reputation, or community.
Termination, suspension, revocation, restriction, or denial of membership does not waive any rights or remedies 8PG may have and does not entitle you to a refund, credit, reinstatement, damages, or future access unless required by law.
6. Membership Cancellation and Deactivation
Because 8PG membership is currently offered at no cost unless otherwise disclosed, you may request deactivation of your membership account by contacting 8PG at info@8pgevents.com or through any available account settings.
A member-requested deactivation does not automatically entitle you to a refund, cancellation of prior purchases, reversal of charges, deletion of records required for legal or operational purposes, release from outstanding obligations, release from this Membership Agreement, release from the Terms of Service, or cancellation of event-specific terms already accepted.
8PG may retain records as described in the 8PG Privacy Policy, including records needed for legal compliance, accounting, fraud prevention, dispute resolution, chargeback defense, event safety, security, enforcement of agreements, or legal claims.
Only 8PG may reinstate a deactivated, suspended, revoked, or terminated membership.
7. Account Registration and Information Accuracy
To apply for membership or access certain benefits, you may be required to create an account, submit a form, register for an event, purchase access, provide contact information, or provide other information requested by 8PG.
You agree that all information you provide to 8PG is accurate, complete, current, and not misleading. You agree to promptly update your information if it changes.
You are responsible for maintaining the confidentiality of your account credentials, access credentials, tickets, QR codes, passes, wristbands, badges, links, purchase confirmations, membership credentials, passwords, and login information.
You are responsible for all activity occurring under your account, credentials, payment method, phone number, email address, membership profile, device, or access pass, whether or not authorized by you, except to the extent prohibited by law.
You may not create an account or obtain membership using false information, another person’s identity, a fake name, a fake age, a fake phone number, a fake email address, a stolen payment method, fraudulent credentials, misleading information, or information designed to evade a ban, suspension, denial, restriction, or enforcement action.
8PG may require you to change your username, password, account details, or access information if 8PG believes your account is no longer secure, your information is inaccurate, your account has been compromised, or your username or account information violates another person’s rights or 8PG’s policies.
You have no ownership interest in your account, username, membership profile, access credentials, tickets, passes, badges, wristbands, or related access rights.
8. Member Conduct and Responsibilities
8PG is committed to maintaining a respectful, inclusive, safe, private, and elevated environment for members, guests, attendees, vendors, sponsors, staff, contractors, and community participants.
You agree to behave respectfully toward other members, guests, staff, vendors, sponsors, exhibitors, venue personnel, contractors, and attendees at all times.
You may not engage in: bullying; harassment; threats; violence; discrimination; stalking; unwanted touching; sexual misconduct; aggressive behavior; disorderly conduct; unsafe conduct; intoxicated or impaired conduct that creates risk; theft; vandalism; trespass; unauthorized access to restricted areas; unauthorized vending; unauthorized promotion; event poaching; unauthorized filming for commercial purposes; disruption of event operations; misuse of cannabis, hemp, alcohol, or other substances; violation of staff, security, venue, or legal instructions; or conduct that damages the reputation, safety, privacy, property, or experience of 8PG, its members, guests, vendors, sponsors, exhibitors, venues, or staff.
Failure to comply with this code of conduct may result in removal from an event, suspension of membership, revocation of membership, permanent ban, forfeiture of access, denial of future purchases, and any other remedies available to 8PG.
9. Website, Content, and Technology Rules
Members may use the 8PG website and related digital properties only for lawful personal, membership, registration, purchase, informational, and event-related purposes in accordance with this Membership Agreement and the Terms of Service.
You may not:
- Use the website for any unlawful purpose.
- Express or imply that any statement you make is endorsed by 8PG without prior written consent.
- Impersonate any person or entity, including any 8PG employee, representative, member, vendor, sponsor, exhibitor, creator, or attendee.
- Submit unlawful, fraudulent, libelous, defamatory, infringing, abusive, threatening, obscene, sexually explicit, harassing, hateful, discriminatory, violent, exploitative, misleading, or otherwise objectionable content.
- Submit non-public information about 8PG without authorization.
- Submit advertisements, solicitations, chain letters, pyramid schemes, surveys, contests, investment opportunities, unauthorized commercial communications, or promotional materials.
- Submit or link to material that encourages unlawful conduct, glamorizes unsafe substance use, depicts or includes minors in age-restricted contexts, violates cannabis or hemp advertising rules, or contains private information about another person.
- Spam, flood, scrape, harvest, collect, or exploit information about users, members, vendors, sponsors, exhibitors, or attendees.
- Use passwords, codes, links, promotions, presale access, or invitation credentials that were not issued directly to you or that you are not authorized to use.
- Download or distribute copyrighted materials without permission.
- Engage in fraudulent activities.
- Use the website in a way that is abusive, threatening, obscene, disruptive, or in violation of any law, community standard, or 8PG policy.
10. Conditional License to Site and Content
The website and all data, text, designs, pages, screenshots, images, artwork, photographs, audio, video, code, HTML, source code, software, event materials, membership materials, benefit materials, ticketing materials, and other content on or made available through the website or 8PG services are owned by 8PG or its licensors.
8PG grants you a limited, conditional, no-cost, non-exclusive, non-transferable, non-sublicensable, revocable license to view the website and content for personal, non-commercial membership-related purposes only, conditioned on your full compliance with this Membership Agreement and the Terms of Service.
You may not:
- Submit software or materials containing viruses, worms, Trojan horses, defects, date bombs, time bombs, malware, spyware, or destructive code.
- Manipulate identifiers, including forged headers, to disguise the origin of any submission.
- Link to any portion of the website other than the homepage without authorization.
- Frame or mirror any part of the website.
- Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, disassemble, or attempt to derive source code, underlying ideas, or algorithms from the website or content.
- Remove copyright, trademark, or proprietary rights notices.
- Use any bot, robot, spider, offline reader, site search/retrieval application, scraper, crawler, data miner, AI agent, automated tool, or manual process to retrieve, index, scrape, train on, copy, harvest, data mine, reproduce, bypass, or circumvent the security structure, navigational structure, access controls, CAPTCHA systems, or presentation of the website or content.
- Use automated software or systems to search for, reserve, buy, or obtain membership, access passes, discount codes, promotional codes, vouchers, credits, gift cards, tickets, credentials, or items available on the website.
- Impose or attempt to impose an unreasonable or disproportionately large load on 8PG’s infrastructure.
- Access, reload, refresh, or make transactional requests to 8PG servers in a manner that disrupts operations, circumvents controls, or exceeds reasonable use.
- Reproduce, modify, display, publicly perform, distribute, or create derivative works from the website or content.
- Reproduce access passes, tickets, QR codes, credentials, or badges in any format or medium different from that provided by 8PG.
- Decode, decrypt, modify, copy, reverse engineer, or manipulate any access pass, barcode, QR code, credential, algorithm, ticket, membership credential, or access technology.
- Circumvent technological measures controlling access to the website, content, ticketing, membership benefits, events, or access credentials.
- Use bot technology or automated purchasing software to search for, reserve, purchase, or obtain access.
This license exists only while you strictly comply with every applicable provision of this Membership Agreement and the Terms of Service. Any unauthorized use exceeds the scope of this license, terminates the license, and may constitute infringement of 8PG’s copyrights, trademarks, patents, trade secrets, database rights, contractual rights, and other legal rights.
You acquire no ownership rights by using the website, content, membership benefits, tickets, access passes, or 8PG services.
11. User Content, Forums, Reviews, and Submissions
8PG may host member reviews, message boards, blog feeds, social media feeds, community features, forms, surveys, forums, and other interactive features. You may also submit suggestions, reviews, comments, concepts, audio recordings, video recordings, photographs, artwork, feedback, ideas, social media tags, direct messages, testimonials, or other materials.
“User Content” means any content you submit, upload, post, tag, display, transmit, message, review, comment, share, or otherwise provide in connection with 8PG, including through the website, events, social media, forms, surveys, communications, sponsor activations, vendor interactions, or other 8PG services.
By submitting User Content, you represent and warrant that: you are at least 21 years old; you own or control all rights necessary to submit the User Content; your User Content does not violate any law; your User Content does not infringe, misappropriate, or violate any intellectual property, privacy, publicity, contractual, or other rights; your User Content does not contain unlawful, defamatory, harassing, abusive, obscene, threatening, hateful, discriminatory, violent, exploitative, fraudulent, misleading, or otherwise objectionable material; your User Content does not contain malware, spyware, tracking code, or harmful software; your User Content does not disclose private information about another person without authorization; your User Content does not falsely imply endorsement, sponsorship, affiliation, or approval by 8PG; you have obtained written permission from every identifiable person appearing in the User Content to allow 8PG to use that person’s name, image, likeness, voice, and appearance in the manner contemplated by this Membership Agreement; and your User Content does not include minors in age-restricted, cannabis-adjacent, hemp-related, or adult-only contexts.
You grant 8PG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable, non-exclusive license to use, reproduce, copy, modify, adapt, publish, translate, distribute, display, perform, create derivative works from, archive, commercialize, promote, and otherwise exploit User Content in any media or format now known or later developed, for any lawful business, marketing, promotional, operational, archival, legal, safety, or commercial purpose, without compensation, notice, inspection, approval, acknowledgment, or attribution to you.
8PG has no obligation to post, display, use, preserve, return, or attribute User Content.
8PG may monitor, remove, edit, restrict, disable, disclose, or delete User Content at any time and for any reason, including to operate the website, protect 8PG, protect sponsors, protect users, comply with legal obligations, respond to governmental requests, investigate violations, enforce agreements, or avoid risk.
You are solely responsible for your User Content and the consequences of posting, sharing, submitting, or transmitting it. You agree to indemnify 8PG for claims arising from your User Content.
12. Social Media Conduct
Members are encouraged to engage with 8PG’s social media profiles in a respectful, lawful, and brand-appropriate manner.
You may not post, tag, upload, share, comment, message, or distribute content connected to 8PG that is unlawful, abusive, threatening, obscene, harassing, defamatory, discriminatory, invasive of privacy, misleading, infringing, harmful, unsafe, or inconsistent with 8PG’s brand, event rules, safety standards, or community expectations.
You must respect the privacy, image rights, intellectual property rights, and safety of others when posting or sharing social media content connected to 8PG.
8PG may remove, hide, report, restrict, block, or request removal of content that violates this Membership Agreement, violates the Terms of Service, infringes 8PG rights, violates platform rules, compromises event safety, reveals confidential information, misrepresents 8PG, harms the 8PG brand, or violates the rights of others.
You may not use 8PG events, venues, members, guests, vendors, sponsors, exhibitors, staff, or content for unauthorized commercial media, press, advertising, monetized content, paid promotion, product placement, lead generation, brand campaigns, event promotion, or competitor promotion without 8PG’s prior written approval.
13. DMCA and Copyright Complaints
If you believe in good faith that content on the website infringes your copyright, you may send 8PG a notice requesting that the content be removed.
The notice must include: your physical or electronic signature, or the signature of your authorized agent; identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved; identification of the content claimed to be infringing or the subject of infringing activity, with information reasonably sufficient to allow 8PG to locate the content; your name, address, telephone number, and email address, if available; a statement that you have a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, you may send a counter-notice.

False claims under the DMCA may result in legal penalties. You should consult a legal advisor before filing a notice or counter-notice.
8PG may terminate, restrict, or suspend access for repeat infringers in appropriate circumstances.
14. Third-Party Links, Platforms, and Services
The website, communications, event pages, membership pages, sponsor activations, and digital properties may contain links to third-party websites, platforms, processors, plugins, embedded media, ticketing providers, payment processors, delivery providers, social media platforms, analytics tools, advertising platforms, retargeting platforms, sponsor websites, vendor websites, or other third-party services.
8PG does not control and is not responsible for third-party websites, content, policies, security, privacy practices, representations, products, services, or conduct.
The presence of a link, integration, sponsor, vendor, platform, or third-party tool does not imply endorsement, approval, guarantee, or responsibility by 8PG.
Your use of third-party websites, platforms, processors, and services is at your own risk and subject to the applicable third party’s terms and privacy policies.
15. Parental Controls and Underage Access
Membership and age-restricted 8PG services are available only to individuals who are at least 21 years of age, unless a specific non-age-restricted offering expressly states otherwise in writing.
8PG does not knowingly direct age-restricted services to individuals under 21 and does not knowingly permit underage individuals to access age-restricted membership benefits or events.
Parents and guardians are responsible for supervising minors’ internet use. Parental control tools may be available to assist in limiting access to material that may be inappropriate for minors.
If 8PG learns that an ineligible or underage person has created an account, applied for membership, registered for an event, purchased access, or attempted to access age-restricted services, 8PG may delete, restrict, retain, or document information as reasonably necessary to comply with law, prevent future unauthorized access, protect safety, or enforce its rights, as described in the 8PG Privacy Policy.
16. Access From Outside the United States
The website, membership, events, benefits, and services are directed to people residing in the United States.
8PG does not represent that the website, membership, content, events, benefits, products, or services are appropriate or available outside the United States.
8PG may limit the availability of the website, membership, events, products, benefits, or services to any person or geographic area at any time.
If you access the website or services from outside the United States, you do so at your own risk and are responsible for compliance with applicable laws.
17. Promotions, Sweepstakes, Contests, Giveaways, and Games
8PG may offer sweepstakes, contests, games, giveaways, promotions, sponsor activations, member opportunities, or similar programs.
Promotions may be subject to specific official rules, eligibility requirements, age requirements, entry limits, prize terms, tax obligations, and additional legal requirements.
By participating in a Promotion, you agree to the applicable Promotion rules in addition to this Membership Agreement and the Terms of Service.
If Promotion rules conflict with this Membership Agreement, the Promotion rules control for that Promotion only, except that the arbitration agreement, class action waiver, representative action waiver, jury trial waiver, media release, privacy terms, and liability limitations continue to apply unless expressly prohibited by law.
No purchase is required to enter a Promotion where prohibited by law.
18. Mobile Applications and Digital Services
If 8PG offers a mobile application, digital membership platform, digital credential, digital wallet pass, QR code, member portal, or software service, 8PG grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install or use the applicable digital service on a device you own or control, solely for personal, non-commercial membership and event-related purposes.
8PG does not grant rights to documentation, support, upgrades, maintenance, enhancements, source code, or related systems unless expressly stated in writing.
You are responsible for your own device, internet access, wireless connection, carrier charges, data charges, security settings, and use of digital services.
8PG is not responsible for interactions between users, location transmission, device compatibility, app store rules, service interruptions, mobile carrier issues, or third-party platform conduct to the fullest extent permitted by law.
19. Purchases, Ticketing, Access Passes, and Purchase Policy
Purchases through 8PG may include membership-related access, event access, tickets, access passes, VIP upgrades, judge kits, merchandise, digital goods, sponsorships, vendor fees, exhibitor fees, or other event-related products and services.
All prices are stated in U.S. Dollars unless otherwise disclosed.
8PG may accept payment methods made available at checkout, including major credit cards, debit cards, electronic payment methods, third-party processors, or other approved methods.
You may only use payment methods that belong to you or that you are expressly authorized to use.
Prices, availability, access, inventory, event capacity, ticket quantities, membership benefits, promotions, and offers may vary and may change at any time.
Purchases may be subject to fees, taxes, service charges, delivery charges, processing charges, shipping charges, and other amounts disclosed at or before checkout.
If you do not receive an order confirmation after submitting payment information, it is your responsibility to confirm your order status with 8PG. Lack of confirmation does not necessarily mean the order failed.
8PG may limit the number of access passes, tickets, benefits, discounts, promotions, credentials, or items available to any person, account, payment method, billing address, shipping address, household, email address, phone number, IP address, device, or membership profile.
Orders placed or attempted using false, misleading, incorrect, incomplete, unverifiable, unauthorized, or suspicious information are subject to cancellation at any time.
If the amount charged is incorrect, if access is made available before its intended release time, if access is mistakenly released, if access is offered due to technical error, or if you are otherwise ineligible to purchase or receive access, 8PG may cancel the access or order and refund the amount paid where appropriate.
8PG is not liable for travel, lodging, transportation, parking, missed work, or other expenses incurred in connection with purchase errors, event changes, order errors, canceled access, or ineligibility.
If a refund is processed in error or exceeds the original amount paid, 8PG may recharge the original payment method or seek repayment to the fullest extent permitted by law.
20. Final Sales, No Refunds, and Event Changes
All purchases are final to the fullest extent permitted by law, including tickets, event access, memberships, deposits, VIP upgrades, judge kits, merchandise, digital goods, access passes, sponsorships, vendor fees, exhibitor fees, and other event-related purchases.
Unless 8PG expressly states otherwise in writing or applicable law requires otherwise, purchases are non-refundable, non-cancellable, non-returnable, non-transferable, and not redeemable for cash.
No exceptions are guaranteed for personal circumstances, illness, travel restrictions, travel delays, transportation issues, schedule conflicts, dissatisfaction, late arrival, missed event, failure to attend, failure to redeem benefits, denied entry, removal for misconduct, inability to verify age or identity, weather, venue changes, schedule changes, artist changes, vendor changes, sponsor changes, programming changes, or event modifications.
If an event is canceled, postponed, rescheduled, moved, shortened, modified, or materially changed, 8PG may determine on an event-by-event basis whether any refund, credit, substitution, accommodation, or retained access option will be offered, unless applicable law requires otherwise.
If an event is postponed, rescheduled, or moved, your access may remain valid for the new date, time, or venue, and no further action may be required.
8PG may, in its sole discretion, issue credits, substitutions, accommodations, or exceptions in specific cases, but doing so does not create any obligation to do so in the future and does not waive 8PG’s rights.
No-refund, final-sale, no-cancellation, no-transfer, chargeback, waiver, and access-control terms may also be displayed at checkout, on ticket pages, on event pages, in purchase confirmations, in registration flows, in waiver forms, or at event check-in. Any such disclosures are incorporated into this Membership Agreement and are intended to be conspicuous, binding, and enforceable to the fullest extent permitted by law.
21. Chargebacks, Payment Disputes, and Payment Abuse
You agree to contact 8PG first at info@8pgevents.com before initiating any payment dispute, chargeback, ACH reversal, card dispute, processor claim, platform dispute, refund demand, or similar reversal request.
To the fullest extent permitted by law, you agree not to initiate a chargeback or payment reversal for any purchase that was authorized by you or anyone using your account, payment method, email address, phone number, billing address, shipping address, membership profile, device, IP address, or credentials, except in cases of true unauthorized payment fraud.
A chargeback, ACH reversal, payment dispute, processor claim, or similar reversal initiated after ticket delivery, digital delivery, event attendance, membership use, benefit redemption, shipment, access grant, credential issuance, RSVP confirmation, or use of any 8PG service may constitute material breach of this Membership Agreement and the Terms of Service.
Consequences may include: immediate suspension of membership; termination of membership; cancellation of tickets; revocation of credentials; removal from guest lists; denial of future purchases; denial of future event access; blacklisting of associated accounts, households, payment instruments, emails, phone numbers, billing addresses, shipping addresses, IP addresses, devices, and membership profiles, where permitted by law; submission of evidence to payment processors, banks, card networks, fraud-prevention vendors, ticketing platforms, dispute-resolution systems, and legal authorities; collection efforts; arbitration or legal action; and recovery of fees, costs, and damages.
8PG may submit evidence including transaction records, IP addresses, device data, communications, checkout assent records, delivery records, attendance records, scan records, membership records, event access logs, benefit redemption records, security records, and other relevant information.
To the fullest extent permitted by law, you are responsible for the original transaction amount, chargeback fees, processor fees, bank fees, penalties, administrative costs, investigation costs, collection costs, attorneys’ fees, arbitration costs, court costs, and any other damages or costs incurred by 8PG in connection with improper payment disputes, payment abuse, friendly fraud, chargeback abuse, or collection of unpaid amounts.
Where legally enforceable, 8PG may charge or seek liquidated damages of up to $1,000 for administrative, legal, processing, investigation, documentation, and operational costs associated with a chargeback or payment dispute filed in violation of this Membership Agreement. This amount is intended as a reasonable good-faith estimate of difficult-to-calculate damages and not as a penalty. If a court or arbitrator finds the amount unenforceable, the amount will be reduced to the maximum enforceable amount or replaced by actual recoverable damages, fees, and costs.
8PG may send unpaid balances to collections, pursue arbitration, pursue court remedies where permitted, seek injunctive relief, report fraud, and take any lawful enforcement action available.
22. Strict Event Poaching, Solicitation, and Unauthorized Promotion Policy
8PG invests substantial time, money, goodwill, strategy, venue access, sponsor relationships, vendor relationships, brand relationships, guest relationships, influencer relationships, member relationships, staffing, production, marketing, and intellectual property into its private events.
You may not use 8PG events, venues, guest lists, member access, sponsor access, vendor access, exhibitor access, staff, branding, media, event layouts, event setup, private communications, member community, or event environment for unauthorized commercial gain, event poaching, solicitation, lead generation, unfair competition, competitor promotion, or non-8PG promotional activity.
“Event Poaching” and unauthorized solicitation include, without limitation:
- Approaching brands, vendors, sponsors, exhibitors, creators, influencers, staff, guests, attendees, or members for your own event, company, agency, brand, project, promotion, or personal business.
- Distributing flyers, business cards, QR codes, pitch decks, menus, samples, discount codes, contact forms, promotional links, or promotional materials for any non-8PG event, company, product, service, or opportunity.
- Mentioning, inviting, recruiting, soliciting, pitching, or redirecting guests, vendors, sponsors, exhibitors, staff, creators, influencers, or members for an external event, competing event, afterparty, brand activation, sponsorship, vendor opportunity, business deal, or commercial activity while at or in connection with an 8PG event.
- Using 8PG’s venue, event setup, event design, branding, staff, guest list, member list, sponsor list, vendor list, influencer presence, likeness, photography, footage, or reputation for personal promotional gain.
- Capturing contacts, leads, content, footage, or business opportunities at an 8PG event for unauthorized commercial use.
- Promoting or selling any product, service, ticket, event, membership, subscription, sample, brand, or business without prior written authorization from 8PG.
- Presenting yourself as affiliated with, approved by, sponsored by, partnered with, or endorsed by 8PG without prior written authorization.
- Redirecting or attempting to redirect 8PG relationships, members, vendors, sponsors, exhibitors, guests, or opportunities for personal or third-party commercial gain.
8PG may immediately remove any person engaged in Event Poaching, unauthorized solicitation, or unauthorized promotion. Security personnel have authority to remove attendees for conduct deemed disruptive, unsafe, unauthorized, or inconsistent with 8PG rules, in accordance with safety protocols and applicable law.
Where legally enforceable, any person or business that engages in Event Poaching, unauthorized solicitation, unauthorized promotion, misappropriation of 8PG opportunities, or unauthorized commercial use of 8PG events may be liable for liquidated damages of up to $10,000 per violation. This amount is intended as a reasonable, commercially appropriate, good-faith estimate of difficult-to-calculate damages, including lost opportunity costs, reputational harm, disruption, misuse of 8PG’s platform, diversion of business relationships, interference with event operations, and misappropriation of 8PG’s investment, goodwill, and consulting time. The amount is not intended to punish. It applies only where the violation causes, contributes to, or is reasonably likely to cause commercial, reputational, operational, relationship, competitive, or brand harm to 8PG.
If a court or arbitrator finds the liquidated damages amount unenforceable, excessive, or not recoverable for a particular violation, the amount will be reduced to the maximum enforceable amount or replaced by actual recoverable damages, disgorgement, restitution, injunctive relief, attorneys’ fees where available, and any other lawful remedy. Liquidated damages are cumulative of, and do not limit, 8PG’s right to seek injunctive relief, actual damages, equitable relief, account restrictions, membership termination, event bans, or other available remedies to the fullest extent permitted by law.
8PG may pursue payment from the violator personally and from any associated business, brand, agency, employer, sponsor, promoter, company, or entity that authorized, benefited from, directed, assisted, or participated in the conduct, to the fullest extent permitted by law.
All Event Poaching, unauthorized solicitation, and unauthorized promotion remedies are cumulative and do not limit 8PG’s rights to remove the person, revoke membership, ban future access, preserve evidence, notify affected parties, pursue injunctive relief, pursue arbitration, pursue court remedies where permitted, or seek any other lawful remedy.
23. Security, Event Rules, and Prohibited Items
8PG reserves the right to remove any member, guest, attendee, vendor, sponsor, exhibitor, creator, influencer, contractor, or participant at any time for behavior deemed disruptive, unsafe, unauthorized, inappropriate, unlawful, intoxicated, noncompliant, threatening, harassing, or inconsistent with 8PG’s standards, rules, safety protocols, brand, community, or event experience.
Security personnel have authority to remove attendees for disruptive, unsafe, unauthorized, or noncompliant behavior in accordance with safety protocols and applicable law. Attendees may be escorted from the premises if necessary to protect safety, privacy, security, property, event operations, or the experience of others.
Members must comply with all venue rules, event rules, posted rules, laws, regulations, security instructions, staff instructions, access controls, age verification requirements, and event policies.
As a condition of entry, attendance, participation, or continued presence at any 8PG event, you consent to reasonable security screening, including bag checks, ID checks, credential checks, age verification, metal detector screening, visual inspection, access verification, pat-downs where lawful and appropriate, and other reasonable security measures.
You may refuse screening, but refusal may result in denial of entry or removal without refund or credit to the fullest extent permitted by law.
Unless expressly authorized in writing by 8PG, prohibited items include: firearms, ammunition, weapons of any kind, knives, explosives, fireworks, drones, illegal substances, outside alcohol, unauthorized promotional materials, unauthorized vending materials, counterfeit goods, open flames, hazardous materials, disruptive objects, large bags or items prohibited by venue rules, professional camera, audio, video, lighting, livestreaming, or production equipment intended for commercial use, and any item 8PG, venue staff, or security determines may create a safety, legal, operational, brand, or guest-experience concern.
Possession of prohibited items may result in denial of entry, confiscation where permitted by law, requirement to remove the item from the venue, removal from the event, forfeiture of access, suspension of membership, permanent ban, or referral to law enforcement.
After removal, you must leave the venue and surrounding private property immediately. Refusal to leave after removal may constitute trespass and may result in law enforcement involvement.
24. Event Access, Tickets, Credentials, and Non-Transferability
Event access, tickets, passes, credentials, wristbands, badges, QR codes, guest list placements, VIP upgrades, judge access, membership benefits, and event access rights are limited, revocable, personal, non-transferable licenses.
They are not property rights, ownership rights, guaranteed admission rights, or unrestricted rights of access.
Access rights may not be sold, resold, auctioned, transferred, assigned, brokered, bartered, raffled, duplicated, screenshot-sold, bundled, commercially exploited, or used for advertising, promotions, contests, sweepstakes, giveaways, or unauthorized campaigns without 8PG’s prior written permission.
Unlawful resale, attempted resale, counterfeit access, copied access passes, duplicated QR codes, transferred credentials, or unauthorized access activity may result in seizure where lawful, cancellation of access, cancellation of membership, denial of entry, removal, forfeiture of payment, restriction of purchasing privileges, and any other remedies available to 8PG.
8PG may refuse to honor pending or future purchases made from accounts, payment methods, devices, addresses, IP addresses, or users associated with policy violations.
25. Cannabis, Hemp, Intoxication, and Age-Restricted Environments
8PG events and experiences may include cannabis culture, cannabis-adjacent products, hemp-derived products, accessories, educational materials, sponsors, vendors, exhibitors, private lounges, demonstrations, product displays, giveaways, or age-restricted subject matter.
Cannabis, hemp, intoxicating hemp, cannabinoids, accessories, sampling, gifting, demonstrations, consumption, advertising, sponsorship, product display, and event participation rules may differ by federal, state, county, city, venue, license type, and product category.
You are solely responsible for understanding and complying with all laws applicable to your possession, use, consumption, transportation, purchase, transfer, receipt, sharing, gifting, or interaction with any cannabis, hemp, product, sample, gift, giveaway, accessory, vendor, sponsor, exhibitor, or attendee.
Nothing provided by 8PG constitutes medical advice, legal advice, therapeutic advice, dosing advice, consumption advice, product safety advice, or a recommendation to use, consume, purchase, possess, transport, or combine any product or substance.
8PG makes no representation or warranty regarding the legality, potency, effects, safety, ingredients, quality, testing, labeling, compliance, authenticity, availability, suitability, or fitness of any product, sample, giveaway, gift, item, display, demonstration, or third-party offering provided, sold, promoted, displayed, gifted, sampled, described, or made available by any vendor, sponsor, exhibitor, attendee, or third party.
You agree that any consumption, possession, use, purchase, receipt, or interaction with cannabis, hemp, food, beverage, supplements, products, accessories, samples, gifts, or third-party offerings is voluntary and at your own risk.
8PG may deny entry, remove, or refuse service to any person who appears intoxicated, impaired, unsafe, noncompliant, disruptive, underage, or otherwise unfit to participate safely.
26. Food, Beverage, Allergies, and Catering
Food, beverages, snacks, samples, infused or non-infused items, catered items, vendor items, sponsor items, gifts, or hospitality offerings may be provided by independent third parties.
8PG does not guarantee that any food, beverage, sample, or consumable item is free from allergens, contaminants, cross-contact, mislabeling, spoilage, or other risks.
You are solely responsible for reviewing ingredients, asking questions, avoiding allergens, managing dietary restrictions, and making safe consumption decisions.
8PG is not responsible for allergic reactions, foodborne illness, adverse reactions, contamination, mislabeling, dietary issues, or third-party food or beverage claims to the fullest extent permitted by law.
27. Parking, Valet, Shuttle, Transportation, and Rideshare
8PG may provide, arrange, suggest, coordinate, communicate about, or facilitate parking, valet, shuttle, rideshare, transportation, offsite parking, pickup/drop-off areas, or related logistics.
Such services may be operated by independent third parties, venues, parking operators, valet providers, shuttle providers, rideshare companies, transportation companies, contractors, or municipalities.
You are solely responsible for your transportation choices, timing, conduct, belongings, vehicle, personal safety, and compliance with all transportation, traffic, parking, rideshare, shuttle, and venue rules.
8PG is not responsible for vehicle damage, theft, lost property, towing, parking tickets, accidents, delays, shuttle incidents, valet incidents, rideshare incidents, transportation provider conduct, or third-party transportation claims to the fullest extent permitted by law.
28. Event Changes, Availability, and Force Majeure
All events, schedules, venues, experiences, activations, vendors, sponsors, exhibitors, performers, speakers, artists, hosts, talent, menus, giveaways, samples, products, benefits, layouts, access areas, capacity, transportation plans, entry times, and programming are subject to change without notice.
8PG does not guarantee the appearance, availability, participation, performance, schedule, timing, quantity, or quality of any vendor, sponsor, exhibitor, performer, artist, host, talent, activation, giveaway, product, sample, benefit, or experience.
8PG may cancel, postpone, reschedule, relocate, modify, shorten, extend, suspend, or terminate any event or offering due to weather, fire, flood, earthquake, natural disaster, emergency, power outage, venue issue, government action, permit issue, law enforcement issue, public health issue, labor issue, transportation disruption, vendor failure, sponsor failure, security concern, safety concern, technical failure, utility failure, terrorism, civil unrest, war, epidemic, pandemic, acts of God, or any other circumstance beyond 8PG’s reasonable control.
Unless otherwise required by law or expressly stated in writing by 8PG, event changes, schedule changes, vendor changes, sponsor changes, talent changes, venue changes, weather, delays, access limitations, partial event closures, or changes in programming do not entitle you to a refund, credit, chargeback, cancellation, or damages.
29. Ownership of 8PG Intellectual Property
The website, content, designs, graphics, layouts, photographs, videos, text, copy, software, source code, databases, event names, brand names, logos, trademarks, service marks, trade dress, slogans, artwork, membership materials, event materials, ticketing materials, judge materials, VIP materials, sponsor materials, and all related intellectual property are owned by 8PG or its licensors and are protected by law.
8PG remains the sole and exclusive owner of all 8PG trademarks, service marks, logos, names, products, services, event names, brand elements, designs, and related intellectual property, including all related goodwill.
You may not use, copy, reproduce, modify, distribute, display, sell, resell, print, manufacture, counterfeit, create derivative works from, register, imitate, or exploit any 8PG intellectual property without 8PG’s prior written permission.
Members may not record, distribute, publish, sell, license, monetize, use, or commercially exploit event content, event photography, event recordings, event footage, 8PG branding, 8PG venue details, 8PG marks, or 8PG event materials without prior written authorization.
Unauthorized use of 8PG intellectual property may result in removal from an event, cancellation of access, suspension or termination of membership, permanent ban from future 8PG events, legal action, injunctive relief, damages, attorneys’ fees, and any other remedies available to 8PG.
Where legally enforceable, unauthorized use of 8PG’s name, logo, event images, branding, confidential event details, or intellectual property may result in liquidated damages of up to $10,000 per violation. This amount is intended as a reasonable good-faith estimate of difficult-to-calculate damages and not as a penalty. If a court or arbitrator finds the amount unenforceable, the amount will be reduced to the maximum enforceable amount or replaced by actual recoverable damages, disgorgement, injunctive relief, attorneys’ fees where available, and any other lawful remedy.
If unauthorized materials or goods bearing 8PG marks or intellectual property are brought to an event, 8PG may require immediate removal of those materials, deny entry, remove the responsible person, preserve evidence, request surrender where lawful, contact law enforcement where appropriate, and pursue all available remedies.
30. Confidentiality and Private Event Information
Certain 8PG events, venues, addresses, guest lists, member lists, schedules, access instructions, private communications, VIP areas, judge materials, sponsor information, vendor information, internal operations, and event details may be confidential or access-controlled.
You may not disclose, publish, sell, transfer, post, scrape, harvest, share, leak, or commercially exploit confidential or private 8PG information without prior written authorization.
8PG may revoke access, suspend membership, remove attendees, ban users, or pursue legal remedies for unauthorized disclosure or misuse of confidential or private event information.
31. Recording, Transmission, Exhibition, Image, Likeness, and Publicity Rights
By attending, entering, participating in, or remaining at any 8PG event, venue, activation, lounge, hospitality area, parking area, shuttle area, check-in area, vendor area, sponsor area, or related space, you consent to being photographed, filmed, livestreamed, recorded, captured, and otherwise documented by 8PG, its media teams, venue operators, sponsors, vendors, exhibitors, partners, attendees, creators, or other third parties.
You understand and agree that 8PG events are private events, but your appearance, actions, statements, conduct, participation, and presence inside and around an event venue may be captured and used as provided in this Membership Agreement.
You grant 8PG a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable right and license to use, reproduce, display, distribute, edit, publish, broadcast, stream, post, advertise, promote, commercialize, and otherwise exploit your name, image, likeness, voice, appearance, performance, acts, poses, movements, statements, social media handle, biographical information, and event participation in any media now known or later developed, including websites, social media, advertisements, recap videos, press materials, sponsor decks, investor decks, internal materials, event promotions, and future marketing, without compensation, notice, inspection, approval, or attribution.
You waive any claims based on right of publicity, right of privacy, false light, defamation, misappropriation, moral rights, approval rights, compensation rights, or similar rights arising from lawful use of event media to the fullest extent permitted by law.
The prior version of this Membership Agreement stated that event media usage excluded product endorsements, commercial advertisements, or monetized campaigns without express written consent and allowed opt-out requests at check-in. That limitation is replaced by this broader media release to the fullest extent permitted by law.
No opt-out from event photography, video, audio, livestreaming, security recording, recap footage, sponsor coverage, or event media is guaranteed. 8PG may, in its sole discretion, attempt to provide a courtesy accommodation if you notify staff before or at check-in, but any such accommodation is not guaranteed, may not be feasible, does not apply to crowd shots, background appearances, security footage, livestreams, third-party footage, venue footage, sponsor/vendor footage, or content already captured, and does not limit or waive the media release granted in this Membership Agreement.
If applicable law requires additional consent for a specific endorsement, testimonial, biometric use, or regulated advertising use, 8PG will seek additional consent where required.
If you do not want to be photographed, filmed, recorded, or included in event media, do not attend 8PG events.
For virtual events, you may view the virtual event solely for your own personal, non-commercial purpose. You may not record, copy, publicly exhibit, transmit, distribute, resell, rebroadcast, stream, share login access, or allow others to access any virtual event through your account.
32. Communications, Email, SMS, and Consent
By providing your email address, phone number, or other contact information, you consent to receive transactional, operational, event-related, membership-related, legal, safety, customer service, and, where consent is provided, marketing communications from 8PG and its service providers.
Communications may include membership updates, event announcements, ticketing and access updates, guest list confirmations, security notices, safety notices, weather notices, parking notices, transportation notices, schedule notices, venue notices, purchase confirmations, customer service messages, newsletters, sponsor announcements, abandoned checkout reminders, VIP communications, and access-related communications.
By opting into SMS marketing communications, you agree to receive recurring automated and non-automated promotional text messages from 8PG at the phone number provided. Consent to receive marketing text messages is not a condition of purchase. Message frequency may vary. Message and data rates may apply. You may opt out of SMS marketing messages at any time by replying STOP. For help, reply HELP or contact info@8pgevents.com.
You may opt out of marketing emails using the unsubscribe link in marketing emails or by contacting info@8pgevents.com. Even if you opt out of marketing communications, 8PG may continue sending non-marketing transactional, legal, operational, safety, account, membership, purchase, and event-access communications where permitted by law.
33. Accessibility and Accommodation Requests
8PG aims to operate events and services in a manner consistent with applicable accessibility laws.
If you require a reasonable accommodation, you must contact 8PG as early as possible at info@8pgevents.com with sufficient information to allow review and coordination. Accommodation requests are evaluated on a case-by-case basis.
8PG does not guarantee that every venue, activation, outdoor area, private property, historic property, parking area, shuttle area, pool area, lounge, stage, or event feature will be fully accessible in every respect, but 8PG will make legally required reasonable accommodations where applicable and feasible.
34. Separate Waiver and Event-Entry Release
Because 8PG events may involve private venues, outdoor areas, pools, stairs, crowds, transportation, security screening, cannabis-adjacent environments, third-party vendors, food, beverages, sponsor activations, and other elevated-risk conditions, 8PG may require you to sign or electronically accept a separate Waiver and Release, Assumption of Risk, Media Release, event-entry agreement, or venue-specific release before allowing entry or participation.
Any separate waiver, release, assumption-of-risk document, event-entry agreement, posted event notice, or check-in acknowledgment is incorporated into this Membership Agreement by reference and applies in addition to the assumption of risk, release, indemnity, and limitation of liability provisions below.
Refusal to sign or electronically accept a required waiver, release, assumption-of-risk document, event-entry agreement, or event notice may result in denial of entry, removal, cancellation of access, or forfeiture of event participation rights without refund or credit to the fullest extent permitted by law.
35. Assumption of Risk
You understand and agree that attendance at private events, venues, lounges, activations, hospitality areas, pools, outdoor areas, parking areas, shuttle areas, valet areas, sponsor areas, vendor areas, and access-controlled environments involves inherent, foreseeable, and unforeseeable risks.
Risks may include, without limitation: slip, trip, and fall risks; pool, spa, water, deck, and wet surface risks; stair, balcony, railing, elevation, and uneven surface risks; lighting, sound, crowd, smoke, fog, heat, weather, and visibility risks; objects, equipment, materials, or items entering guest areas; parking, valet, shuttle, transportation, rideshare, and traffic risks; security incidents; altercations; theft; lost property; property damage; food, beverage, allergy, and contamination risks; adverse reactions; communicable disease risks, including COVID-19 and other bacteria, viruses, pathogens, or illnesses; cannabis, hemp, intoxication, impairment, and overconsumption risks; vendor, sponsor, exhibitor, or third-party product risks; medical emergency risks; outdoor terrain risks; private venue risks; equipment, production, electrical, lighting, audio, staging, and activation risks; and acts or omissions of other attendees, guests, vendors, sponsors, exhibitors, performers, contractors, venue operators, transportation providers, or third parties.
By attending or participating, you knowingly and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, arising out of or relating to your attendance, participation, travel, transportation, consumption, interactions, purchases, use of services, or presence at any 8PG event or related location, to the fullest extent permitted by law.
36. Release, Waiver, Covenant Not to Sue, and California Civil Code Section 1542 Waiver
To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, property managers, production providers, transportation providers, event organizers, and related parties from and against any and all claims, demands, causes of action, damages, liabilities, losses, injuries, costs, and expenses arising out of or relating to: website use, membership, membership benefits, event registration, ticket purchase, event attendance, event entry or denial of entry, removal from an event, security screening, age verification, transportation, parking, valet, shuttle use, food or beverage, cannabis, hemp, or related environments, vendor, sponsor, exhibitor, or third-party interactions, products, samples, gifts, giveaways, demonstrations, or activations, media capture, lost property, theft, personal injury, death, property damage, emotional distress, illness, communicable disease exposure, adverse reaction, schedule changes, venue changes, event cancellation, delay, modification, or relocation, actions taken by venue staff, security, contractors, vendors, event staff, or third-party providers, or any other matter connected with 8PG services, membership, benefits, or events.
This release applies whether claims are known or unknown, suspected or unsuspected, fixed or contingent, accrued or unaccrued, and whether based on contract, tort, negligence, premises liability, strict liability, warranty, statute, equity, or any other legal theory, except to the extent such claims cannot be released under applicable law.
If you are a California resident or if California law applies, you expressly waive the protections of California Civil Code Section 1542, which provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
You understand and agree that this waiver means you may be releasing claims that you do not currently know or suspect to exist. You knowingly, voluntarily, and expressly assume that risk.
Nothing in this Membership Agreement is intended to release claims that cannot legally be waived, including claims for gross negligence, willful misconduct, intentional injury, fraud, or statutory rights that cannot be waived as a matter of law.
37. Venue and Affiliate Liability Waiver
By attending any 8PG event, you expressly agree that, to the fullest extent permitted by law, you will not initiate or participate in any legal action, arbitration, or claim against the venue, venue owner, property manager, security personnel, contractors, vendors, event staff, sponsors, exhibitors, transportation providers, or any third party affiliated with the event or property for claims arising out of or relating to your attendance, participation, travel to or from, or experience connected to an 8PG event.
You release and hold harmless the venue and all affiliated individuals and entities from claims, liabilities, losses, damages, costs, or expenses, whether known or unknown, suspected or unsuspected, foreseeable or unforeseeable, arising out of or related to your attendance, participation, travel to or from, or any experience connected to an 8PG event.
This waiver includes claims related to injury, illness, death, lost property, denied entry, security procedures, venue conditions, event operations, transportation, food, beverage, third-party products, or actions taken by venue staff, security personnel, contractors, vendors, or third-party providers.
This release is intended to be as broad and inclusive as permitted under applicable law.
38. Indemnification
You agree to defend, indemnify, and hold harmless 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, property managers, production providers, transportation providers, event organizers, advertisers, suppliers, and related parties from and against any claims, demands, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- Your use of the website or services.
- Your membership.
- Your membership benefits.
- Your event attendance.
- Your conduct.
- Your User Content.
- Your violation of this Membership Agreement.
- Your violation of the Terms of Service.
- Your violation of event rules.
- Your violation of venue rules.
- Your violation of law.
- Your violation of another person’s rights.
- Your fraud, payment abuse, chargeback abuse, or misrepresentation.
- Your unauthorized use of 8PG intellectual property.
- Your unauthorized resale or transfer of tickets, credentials, or access.
- Your Event Poaching, solicitation, unauthorized promotion, or unfair competition.
- Your possession, use, consumption, transfer, purchase, or transportation of any product or substance.
- Your interactions with other guests, vendors, sponsors, exhibitors, or third parties.
- Your acts or omissions that cause injury, damage, loss, dispute, investigation, enforcement action, or claim.
8PG may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with 8PG’s defense. You may not settle any claim without 8PG’s prior written consent.
39. Disclaimer of Warranties
The website, content, services, events, memberships, benefits, tickets, credentials, communications, merchandise, digital goods, access, products, and all related offerings are provided “as is,” “as available,” and “with all faults” to the fullest extent permitted by law.
8PG disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, quiet enjoyment, safety, legality, suitability, uninterrupted service, error-free operation, and warranties arising from course of dealing, course of performance, or usage of trade.
8PG does not warrant that: the website will be uninterrupted, secure, timely, or error-free; events will occur as scheduled; vendors, sponsors, exhibitors, performers, products, samples, or benefits will be available; any event will meet your expectations; any product, sample, gift, giveaway, or third-party item will be safe, legal, effective, authentic, available, or suitable for you; any content, communication, or information will be accurate, complete, or current; or any defect, error, or issue will be corrected.
8PG is not responsible for the actions, omissions, information, products, services, claims, or conduct of third parties, and you release 8PG from claims and damages, known and unknown, arising out of or connected with third parties to the fullest extent permitted by law.
40. Limitation of Liability
To the fullest extent permitted by law, 8PG and its owners, officers, managers, members, employees, contractors, representatives, agents, affiliates, successors, assigns, event staff, security providers, service providers, vendors, sponsors, exhibitors, venue owners, venue operators, property managers, production providers, transportation providers, event organizers, advertisers, suppliers, and related parties will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, enhanced, multiplied, or similar damages, including lost profits, lost revenue, lost business, lost opportunity, lost data, loss of goodwill, emotional distress, reputational harm, personal inconvenience, substitute services, or other intangible losses.
To the fullest extent permitted by law, 8PG will have no liability or responsibility for: failure of another member, guest, vendor, sponsor, exhibitor, attendee, or third party to follow codes of conduct or event rules; personal injury or property damage arising from access to or use of the website, membership, benefits, events, or venues; unauthorized access to or use of secure servers or Personal Information; bugs, viruses, worms, Trojan horses, defects, time bombs, malware, or destructive code transmitted through the website or third-party platforms; errors, mistakes, inaccuracies, or omissions in content; lost, stolen, damaged, copied, duplicated, or dishonored access passes, tickets, credentials, QR codes, or membership credentials; failure of a venue or third party to honor access; or travel, lodging, parking, transportation, missed work, or other expenses connected to event access or changes.
Your sole and exclusive remedy for dissatisfaction with the website, membership, benefits, or services is to stop using them.
To the fullest extent permitted by law, 8PG’s total cumulative liability for all claims arising out of or relating to this Membership Agreement, the Terms of Service, the website, services, membership, benefits, purchases, tickets, event access, event attendance, merchandise, communications, or any related matter will not exceed the greater of:
- The amount you paid directly to 8PG for the specific product, service, membership, ticket, event, or transaction giving rise to the claim during the 12 months before the claim arose; or
- One hundred dollars.
This limitation applies regardless of the legal theory, whether based on contract, tort, negligence, premises liability, strict liability, warranty, statute, equity, or otherwise, even if 8PG has been advised of the possibility of damages.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.
41. Violation of This Membership Agreement
8PG may investigate any violation or suspected violation of this Membership Agreement, the Terms of Service, event rules, purchase terms, access rules, or law.
8PG may provide law enforcement, regulators, payment processors, card networks, fraud-prevention providers, venues, security providers, ticketing platforms, or legal authorities with information you provide or that 8PG collects in connection with transactions, events, membership, security, disputes, or violations, as permitted by law and described in the 8PG Privacy Policy.
8PG may take legal action that it determines appropriate. You agree that monetary damages may not provide a sufficient remedy for certain violations and that 8PG may pursue injunctive relief, equitable relief, specific performance, account restrictions, access revocation, membership termination, event bans, damages, attorneys’ fees where available, and any other remedies available.
If 8PG determines that you violated this Membership Agreement, the Terms of Service, event rules, or law, or if 8PG determines action is appropriate for safety, security, brand, operational, or legal reasons, 8PG may cancel your membership, delete or restrict your User Content, prevent you from accessing the website, cancel access acquired through your membership, refuse to honor pending and future purchases, restrict accounts associated with you, cancel orders associated with persons acting with you, and exercise any other remedy available.
You agree that 8PG will not be liable to you or any third party for termination of your access, membership, account, benefits, purchases, or related information, and 8PG will not be required to make the website, your account, your membership, or related information available to you after termination, except where required by law.
Your obligations under this Membership Agreement survive termination, suspension, cancellation, event completion, account closure, or discontinued use.
42. Dispute Resolution; Informal Resolution Required
Before filing any arbitration, lawsuit, chargeback, payment dispute, agency complaint, or other formal claim, you agree to first contact 8PG at info@8pgevents.com with written notice describing the dispute, the facts, your requested resolution, your contact information, and supporting documentation.
You and 8PG agree to attempt in good faith to resolve the dispute informally for at least 30 days after 8PG receives your written notice, unless immediate action is required to prevent irreparable harm, protect intellectual property, protect safety, prevent fraud, enforce access restrictions, collect unpaid amounts, or comply with legal obligations.
Any statute of limitations will be tolled during the informal dispute resolution period to the extent required by applicable law.
43. Binding Arbitration Agreement
To the fullest extent permitted by law, you and 8PG agree that any dispute, claim, controversy, or cause of action arising out of or relating to this Membership Agreement, the Terms of Service, the website, services, membership, benefits, purchases, tickets, event access, event attendance, communications, merchandise, User Content, privacy, media rights, payment disputes, chargebacks, Event Poaching, or any relationship with 8PG will be resolved by final and binding individual arbitration, rather than in court.
This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., including its procedural provisions, to the fullest extent permitted by law.
The arbitration will be administered by JAMS under the JAMS rules applicable to the dispute, including the JAMS Streamlined Arbitration Rules and Procedures, JAMS Comprehensive Arbitration Rules and Procedures, or JAMS Consumer Arbitration Minimum Standards, as applicable. If JAMS is unavailable, unwilling, unable to administer the arbitration, or cannot administer the arbitration consistent with this Membership Agreement, the parties will confer in good faith to select a comparable neutral arbitration provider. If the parties cannot agree, a court of competent jurisdiction may appoint a neutral arbitration provider.
The arbitration will be conducted by a single neutral arbitrator. The seat of arbitration will be Los Angeles County, California, unless applicable law requires otherwise or the arbitrator determines that a different location or remote proceeding is required for fairness or legal compliance.
The arbitrator will have exclusive authority to resolve disputes regarding arbitrability, enforceability, interpretation, scope, formation, validity, and application of this arbitration agreement, except that any dispute regarding the class action waiver, jury trial waiver, representative action waiver, or mass arbitration procedures may be decided by a court of competent jurisdiction.
The arbitrator may award the same individual remedies that a court could award, subject to the limitations, waivers, releases, and caps in this Membership Agreement and the Terms of Service.
Arbitration fees, administrative fees, filing fees, arbitrator compensation, and costs will be allocated in accordance with applicable JAMS rules and applicable law. Nothing in this Membership Agreement requires a consumer to pay arbitration fees or costs that would make arbitration unavailable, prohibitively expensive, unconscionable, or unlawful under applicable law. If any fee or cost provision is found unenforceable, it will be modified to the minimum extent necessary to preserve the enforceability of this arbitration agreement while complying with applicable law.
Each party will be responsible for its own attorneys’ fees and costs unless applicable law, this Membership Agreement, the Terms of Service, or the arbitrator permits recovery of fees or costs.
44. Class Action Waiver and Representative Action Waiver
To the fullest extent permitted by law, you and 8PG agree that all disputes must be brought only on an individual basis.
You waive any right to bring, participate in, join, consolidate, or proceed with any class action, collective action, representative action, private attorney general action, mass action, consolidated action, or similar proceeding against 8PG.
The arbitrator may not preside over any class, collective, representative, mass, or consolidated proceeding unless 8PG expressly agrees in writing.
If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request for relief may be severed and brought in court only to the extent required by law, while all remaining claims must proceed in arbitration.
45. Mass Arbitration Procedures
If 25 or more similar arbitration demands are filed against 8PG by or with the assistance of the same law firm, group of law firms, organization, coordinated claimants, or third-party funding source, the demands will be treated as a mass arbitration.
In a mass arbitration, the parties agree that:
- Claims may be batched for staged proceedings.
- No more than 10 demands may proceed to arbitration at one time unless the parties agree otherwise.
- The first batch will be selected randomly or by the arbitration provider.
- Remaining claims will be stayed pending resolution of earlier batches.
- Results from earlier batches may be used to facilitate global mediation or resolution.
- Administrative fees will be assessed in a manner consistent with the arbitration provider’s rules and applicable law.
If any portion of these mass arbitration procedures conflicts with mandatory JAMS rules, consumer arbitration standards, or applicable law, the conflicting portion will be modified to the minimum extent necessary to comply while preserving the parties’ intent to avoid inefficient, duplicative, or coercive mass proceedings.
These procedures are intended to create a fair, efficient, and cost-effective process and must be interpreted to the fullest extent permitted by law.
46. Jury Trial Waiver
To the fullest extent permitted by law, you and 8PG knowingly and voluntarily waive any right to a trial by jury in any dispute, claim, or proceeding arising out of or relating to this Membership Agreement, the Terms of Service, the website, services, membership, purchases, tickets, events, communications, or any relationship with 8PG.
47. Small Claims, Injunctive Relief, and Exceptions
Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.
8PG may seek injunctive or equitable relief in court for claims involving intellectual property, unauthorized use of 8PG marks, confidential information, unauthorized access, fraud, chargeback abuse, Event Poaching, solicitation, unauthorized promotion, trespass, safety threats, harassment, event disruption, nonpayment, or any conduct that may cause irreparable harm.
Nothing in this Membership Agreement prevents either party from reporting matters to law enforcement, regulators, or government agencies.
48. Governing Law and Venue
This Membership Agreement is governed by the laws of the State of California, without regard to conflict of law principles, except where federal law preempts California law or where applicable law requires otherwise.
Subject to the arbitration agreement above, any court proceeding that is not subject to arbitration must be brought in the state or federal courts located in Los Angeles County, California, unless applicable law requires a different venue.
You consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum or lack of personal jurisdiction, to the fullest extent permitted by law.
For events outside California, local event laws, venue rules, cannabis or hemp rules, safety rules, and mandatory consumer protection laws may apply to the extent required by law, but this Membership Agreement will continue to be enforced to the maximum extent permitted.
49. Time Limit to Bring Claims
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to this Membership Agreement, the Terms of Service, the website, services, membership, benefits, purchases, tickets, events, communications, or any relationship with 8PG must be filed within one year after the claim accrues, or it is permanently barred.
This limitation does not apply where prohibited by law.
50. Electronic Assent and Communications
You agree that electronic signatures, checkboxes, clickwraps, account registration, checkout acceptance, RSVP acceptance, ticket purchase, event registration, membership use, continued website use, and event attendance constitute valid and binding acceptance of this Membership Agreement.
You consent to receive legal, transactional, operational, event, membership, purchase, and account communications electronically, including by email, SMS, website notice, account notice, checkout notice, or other electronic means.
You agree that electronic records satisfy any legal requirement that communications or records be in writing, to the fullest extent permitted by law.
51. Assignment
You may not assign, transfer, delegate, sell, or sublicense this Membership Agreement, your membership, or any rights or obligations under this Membership Agreement without 8PG’s prior written consent.
8PG may assign, transfer, delegate, or sublicense this Membership Agreement, in whole or in part, at any time, including in connection with a merger, acquisition, restructuring, financing, sale of assets, transfer of business operations, or by operation of law.
52. No Waiver
No failure or delay by 8PG in exercising any right, power, remedy, or privilege under this Membership Agreement will operate as a waiver.
No waiver will be effective unless in writing and signed by an authorized representative of 8PG.
A waiver of any breach does not waive any other or later breach.
53. Severability and Reformation
If any provision of this Membership Agreement is found invalid, illegal, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and modified or reformed to the minimum extent necessary to make it valid and enforceable.
If modification or reformation is not permitted, the unenforceable provision will be severed, and the remaining provisions will remain in full force and effect.
The parties intend that every provision be interpreted to provide 8PG the maximum lawful protection permitted by applicable law.
54. Survival
Any provision that by its nature should survive termination, expiration, cancellation, event completion, account closure, membership termination, or discontinued use will survive, including provisions relating to intellectual property, User Content licenses, media releases, payment obligations, chargebacks, Event Poaching, unauthorized solicitation, confidentiality, disclaimers, assumption of risk, releases, indemnification, limitation of liability, dispute resolution, arbitration, class action waiver, governing law, and enforcement.
55. Entire Agreement
This Membership Agreement, together with the locked 8PG Privacy Policy, locked 8PG Terms of Service, event-specific terms, waiver terms, purchase terms, ticket terms, posted event rules, checkout disclosures, and any additional terms expressly incorporated by reference, constitutes the entire agreement between you and 8PG regarding your membership and membership-related obligations.
It supersedes all prior or contemporaneous understandings, communications, representations, or agreements regarding the same subject matter, whether oral or written, except for separate written agreements signed by 8PG that expressly state they supersede this Membership Agreement.
The March 2024 and March 2025 membership terms are replaced by this Membership Agreement for all membership activity, event activity, purchases, access, benefits, and interactions occurring on or after the effective date of this Membership Agreement.
56. Acknowledgment of Material Terms
By applying for membership, creating an account, purchasing access, purchasing a ticket, registering for an event, RSVPing, accepting a credential, entering an event venue, attending an event, participating in an 8PG experience, submitting information, checking any box indicating agreement, using any membership benefit, or using any 8PG service, you expressly acknowledge and agree that:
- You are at least 21 years of age unless a specific non-age-restricted offering expressly states otherwise.
- Membership is a limited, revocable, personal, non-transferable privilege and not a property right.
- Your access to any 8PG event is a limited, revocable license and not a property right.
- 8PG may deny membership, deny entry, remove you, revoke access, suspend membership, terminate membership, or ban you for safety, security, misconduct, fraud, underage access attempts, payment abuse, rule violations, Event Poaching, unauthorized solicitation, or any other reason not prohibited by law.
- All purchases are final, non-refundable, non-cancellable, non-returnable, and non-transferable to the fullest extent permitted by law.
- You must contact 8PG before initiating any chargeback, payment dispute, ACH reversal, card dispute, processor claim, or similar payment reversal.
- Improper chargebacks or payment disputes may result in revocation of access, cancellation of membership, denial of future purchases, blacklisting, collection efforts, fee recovery, liquidated damages where enforceable, and legal enforcement to the fullest extent permitted by law.
- Event Poaching, unauthorized solicitation, unauthorized promotion, misappropriation of 8PG opportunities, or unauthorized commercial use of 8PG events may result in immediate removal, membership termination, permanent ban, injunctive relief, actual damages, liquidated damages of up to $10,000 per violation where enforceable, and other legal remedies.
- You assume all known and unknown risks connected with private events, venues, pools, stairs, crowds, transportation, valet, parking, security screening, cannabis-adjacent environments, hemp-related environments, food, beverages, vendors, sponsors, exhibitors, products, samples, activations, communicable diseases, and third-party conduct.
- You release and waive claims against 8PG and related parties to the fullest extent permitted by law, including unknown claims where legally waivable.
- You grant 8PG broad rights to photograph, film, record, livestream, publish, advertise, and commercially use your name, image, likeness, voice, appearance, statements, and event participation without compensation, notice, inspection, or approval.
- You agree to the limitation of liability, damages exclusions, indemnification obligations, arbitration agreement, class action waiver, representative action waiver, jury trial waiver, governing law, venue, and one-year claim limitation stated in this Membership Agreement and the Terms of Service.
- You understand that cannabis, hemp, age-restricted products, third-party vendor products, sponsor activations, samples, gifts, giveaways, food, beverages, and event experiences may involve legal, physical, personal, health, safety, reputational, and financial risks, and that you are solely responsible for your own legal compliance and personal decisions.
- You have had the opportunity to read this Membership Agreement, the locked 8PG Privacy Policy, the locked 8PG Terms of Service, any applicable event terms, purchase terms, waiver terms, and posted rules before using 8PG services, using membership benefits, or attending an event.
